Hello All

I entered on the VWP and have just married my better half. We had no intention to do so when I entered, and I have evidence showing I was due to speak at two conferences in the UK this April and a return flight booked via British Airways.

Some circumstances changed which led to our decision to marry whilst here and now we are filing for AOS.

I have a few questions;

1. On the I-485, what should one answer when asked "I am filing because..."

2. On the Advanced Parole form, if I do not have future travel planned (well, until December), again what should I answer?

3. On the I-130, the VJ guide seems to indicate a need for evidence in the form of joint leases etc. We will have these by interview but right now we don't have joint accounts set up or joint insurances etc. How do we go about this?

Any experience of the form issues when filing AOS is appreciated.

Hi there:

1. you are filing based on a visa availability as an immediate relative

2. I do not know, we did not file for AP (someone will chime in on this one)

3. you do have to submit evidences with your AOS package...you cannot just submit the forms and then bring things to the interview. So, then just wait a bit before you mail your AOS package, go open a bank account, or have your USC spouse add you to their account so it is "joint", change the apartment/house rental agreement to both of your names, get health insurance plan together etc.

Your spouse also need to fill out the form for affidavit of support (I-864), and you, as the foreign citizen, will have to get your medicals done (I-693), and if wish to be able to work while your application is pending, then work authorization (employment authorization document a.k.a. "EAD" through form I-765).

3. It doesn't say you need all of those pieces of evidence. Do you have any of them right now?

Thanks both for your replies.

On item 3, we currently live at my wife's work (she works in Sport), which we can show.

On other items, our understanding is most things we are unable to add me onto until I have a SSN which will be when the EAD comes through, correct? Which means we'll have plenty by interview. We can certainly produce an array of photographic evidence etc, along with of course marriage certificate and affadavits from friends.
