Hi I just have a question.I came in the US Nov 2012, I am a F24.I have 2 children back in the Philippines but I didn't applied them as my derivative when I applied for my visa.Now could I still apply them as derivative under my current visa status or I now need to file a new petition for them?

Did you include the children's names on your DS-230 form (Question #19: List Names, Dates and Places of Birth, and Addresses of ALL Children)?

Did you name them in question #21b (Person/s named in 14 and 19 who will follow you to the United States on a later date)?

If you didn't, you have to file i-130 for them. One for each child.

If the child is Unmarried below 21 years old, he/she will be under the F2A category. Waiting time is 2-3 years.

If the child is Unmarried over 21 years old, he/she will be under the F2B category. Waiting time is 11 years.

Yes I did on questions 19 & 21b. And they are under the age of 21.

They qualify for follow-to-join benefits. You don't have to file a new i-130 for them.
