If I understand this correctly, it was your sister that called the police. Unless you have no possible relations with your sister it is likely to come up at some future family gathering. So, you are right about biting the bullet now. If you are honest with her and she truly loves you, she will understand. Tell her about it and see what happens. I think you are going to be pleasantly surprised.

I think consulting an attorney would be a good idea, but maybe you should wait to see what happens first.

Yes, consulting an attorney might be a good idea, but you don't need to ask them to do for you all, some parts you can do by yourself. we paid for immigration attorney for about 200 USD only for IMBRA law as there were some points that we couldn't translate clearly.

You're better off telling her now, b/c if she ever decides to file a DV case against you and this "never took place" incident shows up...

I agree with this completely. I can't imagine hiding things from Sian. If you think you were wrongly convicted, why would it be a problem to tell your fiance about the incident, including that you feel you were wrongly convicted, etc?

I think, the OP should share this incident with her. And the OP should also consult an attorney. If there is no conviction, then why report it? Sometimes, the court throws away the charge (meaning there is no conviction) once one completes his/her conditions successfully. This is what OP needs to find out from his attorney. Only OP's attorney can answer it.

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

As for your petition, You may have to decide if this is a big issue or not within your own self but one must also be wise to the fact that they have a right

ask you about your records, quilty or not and to know because you are the applicant and they are the reviewer. Part of a reviewers job is to protect the innocent well being of the "international community". They have to answer to the mistake of appoval and let some dangerous person into their country.

Remember Life's to short to go without love. One sometimes has to reveal and give of themselve, yes even the secrets.

so ask your self is it worth it. Am I really in love....HOw deep is your love?

I had a similar situation. My ex-wife had emotional problems which I ignored for years and it finally bit me in the butt. Anyway I pleaded no contest and paid a fine and community service. Bottom line is that after I completed my community service I received an affidavit stating that I had completed my community service and as a result there was "No Conviction". I consulted with an immigration lawyer and he advised me to provide to disclose everything on my RFE. My petition was approved. I am going to discuss the situation with my fiance and my neighbors will also contact her and vouch for my character. I believe you best make you disclosure in order to avoid any complicatons with you application :thumbs:

Aren't cases sealed for minors? If this is the case and you were in fact a minor at the time, I would not disclose it. That is why it is sealed. If you had committed another crime it would have be unsealed.

Sent I-130 to TSC

Received NOA1 from CSC with a date of 8/15/06

I-130 petition approved 4/16/2008 after 19 months.

Got IIN from NVC 5-13-08

Paid AOS fee online 5-14-08, Paid IV Fee online 5-27-08

Sent I-864 forms 5-27-08

Sent DS-230 forms 5-28-08

6-2-08 called NVC and msg says "received all information,processing will take 4-6 weeks"

6-13-08 called NVC, CR1 is complete, sent RFE for CR2. returned to NVC, waitn on result

6-26-08 case complete/approved. Waiting to be transferred to U.S. Embassy in Guangzhou, China for interview date

7-7-08 Petition forwarded to Guanzhou, China. Awaiting interview letter.

Aren't cases sealed for minors? If this is the case and you were in fact a minor at the time, I would not disclose it. That is why it is sealed. If you had committed another crime it would have be unsealed.

From I-129F Instructions:

If you have ever been convicted of any of the following crimes, submit certified copies of all court and police records showing the charges and dispositions for everysuch conviction. This is required even if your records were sealed or otherwise cleared or if anyone, including a judge, law enforcement officer, or attorney, told you that you no longer have a record.

Bloodofheroes, do you now have a decent relationship with your sister now? Time heals many wounds, and if you two are past what happened - perhaps she will explain what occured to your fiance'? Either way, don't hide anything and be upfront - it is easier to ask for forgiveness than permission at times and you could creae a whole set of problems by not being honest now.

the visa sponsor must disclose whether or not they have ever been convicted by a court of law (civil or criminal) or court martialed by a military tribunal of any of the following crimes (even if the records of the conviction were sealed or expunged):

(a) domestic violence, sexual assault, child abuse and neglect, dating violence, elder abuse and stalking;

(B) homicide, murder, manslaughter, rape, abusive sexual conduct, sexual exploitation, incest, torture, trafficking, peonage, holding hostage, involuntary servitude, slave trade, kidnapping, abduction, unlawful criminal restraint, false imprisonment or an attempt to commit any of these crimes; or

© three or more convictions for crimes relating to a controlled substance or alcohol not arising from a single act.

If the visa sponsor has any criminal history that falls under these categories, they will also have to provide certified copies of any related court and/or police records regarding that criminal history. The petition may be approved, even if this type of criminal history is present. However, any such criminal history will be disclosed to the prospective immigrant.

I live in IL, however back in DEC 2002 I was in MN and was part of a fight with my sister. Unfortunately she turned to call the cops.

As a result I was charged and convicted for Domestic Assault (when none ever took place). My charge was reduced to a misdemeanor and was let go with a fine. The record was then sealed after one year.

This was the FIRST and ONLY time that I was arrested in my entire life.

Now IMBRA wants me to reveal this on the I 129-F. I feel that since the record was sealed I should not have to reveal this and there is no reason for my future wife to know about this one time incident.

Does anyonw know what I can do (other than get a lawyer?)

It didnt take place but you were convicted??? makes no sense.

I think that IMBRA requires all disclosures. They dont care even if you were pardoned by the governor, it still has to be disclosed.

why doesnt it make sense.. ?? men are convicted all the time under these feminazi bs laws. Maybe you will find out one day when they come for you

I thought you cant even apply with a conviction... you have to ask for a special waiver and it has to claim that the violence was in self defense.. not that you disclose it to the fiance, but that you cant even apply Am i wrong on this??
