A a friend of mine (UA citizen by birth) have not had a job for the last ten years and so have not file taxes for the last ten years and have never been married, now he met this African lady who is visiting (on a visitors visa) and want to get married to her. They have known each other for the last two years from the ladies prior visit to the State. He wants my advice on this issue. He lives on income from little money he makes from odd jobs like mechanic, cleaning. he lives in a free house given to him by his aunt. Please I need u all input on this issue to enable them process with their wedding. He is now trying to get a job.

Thx

He needs a Joint Sponsos for his wife.

Personally, I would never be a JS for a family member or friend who is so lazy that he doesn't work and lives off the hard work if others. Why would U take financial responsibility for his wife when he's no financially responsible for himself?

My husband had been slacking with his taxes too, what he did was that he filed the last 3 years first. The years he needed to send in, then he sorted out the rest of his tax mess.

So your friend must at least do the required years for now.

And if he can't make enough money he must find a co-sponsor.

You stated your friend has worked, self employed/fre lance. He just didn't report his income as this type of worker is required to do. If I were this lady I would be running the other way because when the tax man catches up to "them" they will garnish whatever money they can find.

This will not be over quickly. You will not enjoy this.

Note that he has to file taxes, not necessarily pay them. If he made under some threshold amount then he won't owe any money. Even if he owes money, it's possible to work out a payment plan with the IRS.

Everyone else has addressed the taxes. You stated that the lady is here on a vistor's visa and they are thinking of getting married. Make him aware that coming here on a vistor's visa with the intent to marry is considered as fraud. He should sort out his tax evasion before he attempts to marry.

Make him aware that coming here on a vistor's visa with the intent to marry is considered as fraud.

Incorrect.

Coming to the US with the intent to marry is fine; coming here on a nonimmigrant visa with the intent to remain would constitute visa fraud.

Hmmm and what might a visitor's visa be?

You are misunderstanding. You are permitted to come to the US on a visitor visa with the intent to marry, just just cannot have intent to stay here and must leave the US to file for a spousal visa.

If it weren't legal to come and marry, how would people get spousal visas? Are you saying ALL American's marrying foreigners must marry outside of the country?? That makes no sense.

Again it's about intent. Its illegal to enter with intent to stay if your visa does not permit it.
