So, I've seen this ad a few times and it confuses me:

Not that I have anything incriminating on my phone - really, I don't - but WTH? Is this opening Pandora's box legally if a friend decides to text at that EXACT moment "Need help hiding the body" or "Scored some sweet bud - meet me in 10". What if the police take it back to the car and decide to snoop around a bit? You gave them permission to take the phone - heck, you handed it to them - can they snoop? I'd think no - 4th amendment and all that - but do we really know?

I know we have to have a couple of attorneys here - what's your opinion?

Plus, just last year the same damn pig was in the back seat of a minivan with a pinwheel thanking a mom for a ride. What's the pig age to human age ratio? Could he really be driving at this point???

Looked all over searching for it, then finally went back to the one in my wallet and the cop had read the start date as the expiration date.

Showing the Police the phone and insurance info I wouldn't mind. But last time I was stopped the cop took the insurance card and my license back to his squad car. Then he gave me a fix it ticket for having and outdated insurance card. I went crazy looking for the latest, because normally I put it in my wallet as soon as it arrives. Looked all over searching for it, then finally went back to the one in my wallet and the cop had read the start date as the expiration date.

Did you realize the mistake while the cop was there or after he left?

The cops around here seem to always go back to their car to research/write up stuff. That's why I'm curious about this.

Also - cause I needed to know - pigs age about 5-7 human years in a calendar year per google. So, I guess under the right circumstances Pig Dude could be driving :lol:

I'd worry about it, as the cop will take yer phone back to the cruiser for some computer checking.

Let's say the cop gets bored or has AD/D and starts scrolling through your phone, looking at yer stuff.

IMO, a piece o paper for insurance ID outweighs the other stuff, aye?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

I know a little about search and seizures....and I say......we'd have to wait for the outcome of the first case where this process incriminates someone who is......about to commit, is commiting, or has committed a crime.....

It is now open to interpretation under "Consent to search" or the "plainview" exception.

a lot of police cruisers are now equipped with "plate readers", where by the time they pull you over, they already know a lot about that car and it's registered owner.

In fact, in the NY VTL (Vehicle Traffic Law). It is no longer required thata driver carry a paper registration.

If he starts scrolling through your phone, and discovers something incriminating. That would be "Fruits of a poisonous tree". Inadmissible. (Unless you're in Texas. In Texas, anything is admissible :))

I think the comments on that article are pretty telling - but I pretext this with saying a know NOTHING about Canadian law. Someone pointed out that checking a phone that wasn't password protected would be similar to police searching an unlocked house therefore checking an non-password protected phone should not be permitted either. From context of that comment, it appears that wouldn't be permitted in Canada and I know isn't permitted here. The house thing - not the phone thing. This case in Canada through the courts appears to uphold the practice that checking a phone is a-okay.

The part that seems messy to me is the voluntary handing over of the phone - you know [or should know] what's in your phone when you hand it over. So, anything prior to that moment is now open game??? If something does come in when in the police's possession, then what? I know this is a one-in-a-million but some people just have that luck :) .
