My husband and I were going through some tough times financially and it took as some time before we filed his I-90. Well we thought we filed the correct form to remove his conditions as a permanent resident. Now I think we should have filed the I-751. So there are two issues. One is they cashed our check for the I-90, sent a letter back over three months later with no refund and denied a replacement but the letter doesnt say anything else. It just said it was denied and gave an address to appeal. I don't know what we are appealing, is it because we were suppose to send the I-751? And does that fee that we paid for the I-90 go toward the I-751? Or was it denied because we were late, and if that is the case how do we proceed. We are happily married. This is so expensive and takes so long. I need help in a hurry! Thank you!!

Well - no refunds of course, why would they refund you ? Also, when was 2 years from your permanent residency ? If you are past that time at this point you are out of status and you will have to explain why you're late sending I-751 in....

The form you sent in was for replacing an existing greencard, not to remove conditions. You do need to send in the I-751. Not sure who you can contact about the money you sent in. You do need to send in the I-751 as soon as possible, along with copies of the form and payment you did send in. G/L.

That is pretty unlikely because they did adjudicate the I-90.

They will not apply anything. Send in I-751 ASAP with correct payment because you are likely out of status now. Sending I-751 with no payment or with any attempts to make them apply I-90 payment (which is gone - as Nola123 said - it had been adjudicated) will be nothing more than waste of time - which you don't quite have. You may end up in removal proceedings if you continue waiting.

Update - we did send the I-751 with a check in March. Husband got one year extension in a few weeks. On Thursday we received his 10 year Permanente residence card! Thank you!!!!!! Woo hoo!!!!
