Victim of marriage fraud

I sponsored a woman for a fiance visa.

We were married for 6 months before she left without a word or even a note.

I had applied for her for a conditional permanent residence card.

I went to immigration 6 weeks after she left.

I told I wanted withdraw the pedition for conditional permanent residence and that I had filed for divorce.

They said the case application was pending.

She had biometric appointment on December 22nd.

I believe she thought her conditional permaent residence card would be approved.

She then left shortly afterward.

We were married for around 6 months before she left.

I had given her a credit card which she had been using to run up thousands of dolllars.

She was using the credit card for cash for when she left.

What recourse do I have to fight this fraud?

I have been reading a lot on this subject.

Apparently this is very common.

In addition I think she may be trying to file false VAWA claims.

There was absolutely no abuse whatsoever.

Simply a path she will try to use to gain citizenship.

The marriage lasted 6 months from what I have read this is a red flag to immigration officials about marriage fraud.

What are the chances of her being able to get away with this fraud?

I believe she has already go involved with another man here.

If she makes a false VAWA to try to obtain a visa.

she has no proof, and it will be completely fabricated.

what are the chances of her being successful with a fraudulent VAWA claim?

All you can do is send any and all information you have on why you think this is a fraud marriage to ICE. They will keep all your info in her records. You can't really do much about the VAWA. Many people do this all the time and get away with it. All you can do is have all your proofs in her file and hopefully it will give her trouble later down the road with any/everything immigration that she tries to do.

Sorry for her actions.

9/17/2011 - sent I-13

09/19/2011 - noa1 received

3/16/2012 - case sent to my local USCIS office for additional processing

4/21/2012 - AP. If we haven't heard from them in SIX MONTHS (omg) we can feel free to call them!!! Thanks!

9/20/2012 - Interview scheduled - October 3!!!!

10/3/2012 - Interview went well but she must look at his A-file more before decision.

10/12/2012 - I-130 APPROVED! APPROVED! APPROVED!

KIDS' CASES

04/20/2012: NOA107/20/2012: instead of an approval, we got thrown into AP. sigh

11/01/2012: Boys' I-130 interview set for November 28, 2012.

11/28/2012: I-130s APPROVED! APPROVED! APPROVED!

12/14/2012: NVC Received

12/31/2012: Case number/IIN

12/31/2012: DS-3032 sent

01/08/2013: DS-3032 accepted

01/02/2013: AOS bill0

1/03/2013: AOS bill shows PAID

01/04/2013: AOS package sent

01/09/2013: IV bill

01/10/2013: IV bill shows PAID

01/11/2013: IV package sent

01/23/2013: Case complete

02/01/2013: Interview scheduled

US Embassy Lagos

02/22/2013: Embassy received

03/01/2013: Medical

03/20/2013: Interview - was told the boys would have been approved on the spot if they had pics! Errrr :-(

04/15/2013: DNA test

05/15/2013: Emailed embassy BEGGING them to let boys drop off passports for visa insertion. IT WORKED!!!

05/31/2013: Visa in hand

06/02/2013: POE JFK!!!!!!

One thing - if she calls and wants to meet you, take one of your friends with you. Never be alone with her. If she is trying to file VAWA, she could try to set you up. Did you pull your affadavit of support? That is the only thing you can do, really, other than sending the info to ICE.

If she has green card you cannot cancel I 864, it is to late, yes it is common to do...but not all immigrant spouses are like this. Some woman are coached in how to do this, my soon to be ex did what your wife has done but waited a year. Go file for divorce/annulment ASAP, waste no time get a annulment if possible. Your proof what you have, once it is in immigration it is out of you hands, it is her file now. VAWA claims and VAWA fraud is very common there is nothing you can do let the system work. Protect yourself and your assets. GET A LAWYER NOW. STOP READING GET A LAWYER.

You should never be alone with this woman. In fact, the only time you need to see her again is in divorce proceedings, though if you're lucky she won't show up and you get divorce in absentia. Hire a lawyer. Great divorce laywers know ####### about immigration and great immigration laywers know ####### about divorce law. You need the great divorce laywer.

File a motion to keep her away from your home. Protect your assets. Record every call and conversation you have with her. Keep a journal of every little thing that has to do with her. NEVER let her be in your presence alone. To increase her chances of a successful VAWA claim she will work to have you arrested for abuse whether it is true or not. DO NOT provide this opportunity to her.

As far as immigration goes - even if she is successfull with the VAWA claim, it is administrative in nature only and has absolutely no impact on you. Let it go.

You must withdrawn form I-864 if she didn't receive her GC yet. DO NOT BE ALONE with her not even for 5mins.If she starts bothering you get a restraining order against her. File for annulment instead divorce and send the annulment decree to Uscis and ICE.Good luck.

If you wish to ensure that no green card is issued where YOU are the sponser, you must get the I-864 withdrawn asap.

If the green card is already issued, there's not much to be done, with Immigration.

re: fraud and use of monies - start with a police report.

Unfortunately we are not allowed to talk about vawa fraud on this board.

And as a result most of my posts here have been deleted.

One of the mods has stated he is trying get my account banned.

All because I dared to share my story here.

As a result I no longer post on this board.

Maybe that will be enough to satisfy him.

But he will probably delete this post as well.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Here is an update on my case, for those interested.

i wrote immigration and removed the affidavit of support.

i also went to immigration in person to withdraw the CPR application and gave them a copy of my divorce filing.

The told me at the time, her application for a CPR card was pending.

So I believe I got their in time to prevent it from being approved.

i also changed my divorce filing to an annulment based on fraud.

last friday i scheduled a hearing date in 3 weeks from wednesday.

she never responded to my summons by publication.

we were only married for 6 months, so i think I have a good chance at getting the annulment.

i will then send that paperwork to immigration in case she files for a VAWA.

which is what i believe she plans to do obviously she has no visa now, or a way to apply for a green card unless she convinces some other gringo to marry her.

absolutely fraud, and annull the marriage based on fraud, and send the papers to INS.

there is no doubt in my mind that she is actively looking for another gringo to take advantage of.

she has probably already found one.

she is nothing but a user, and that's what users do.

Cool ! some movement !

IF the I-864, affadavit of support, was successfully rescinded, then she has no basis to adjust status due to marriage with you, this round.

Sure, she could chase VAWA stuff, but you've a line on that, as well.

Since you went in person to a local USCIS office to handle the withdrawal WHILST the case was pending, I think it was successful, to rescind the I-864. However, USCIS is stupid sometimes, so I suggest you go back soonish and verify that the I-864 was actually withdrawn from that casefile.

It doesn't matter if she marries someone else, since she entered on a K-1 she can only ever adjust status to the person who sponsored her for a K-1, i.e. you.
