Hello everybody,

I have a question. My wife have her green card which expires on December 2013. Currently she's working in U.S. But her U.S Visa expired last year 2012. Her U.S Visa is in her Indian passport. How would I apply for a U.S Visa again? Do I go to the American Embassy? We are planning on an indian trip in 3 weeks and just noticed,

If she has a valid green card, she never needs another US visa. She would enter the USA by presenting her passport AND her green card.

Yes, she have her green card and social security. Green card expires at the end of this year. So it's ok to travel to india as long as she have her valid passport, and green card?

Yes. Is this a two-year green card? If so, you'll be filing removal of conditions in the fall, three months before the card expires. She should be present in the USA when you do that. Otherwise, she's free to travel internationally, India or otherwise.

yes it was a 2 year green card, so just to make sure she can travel to india with an expired u s visa

Her visa is irrelevant now and has been since she received her green card. The issue is not traveling to India. The issue is returning to the USA. For that, she needs her green card, not ever any visa, ever again.

so what's the point of a u.s visa in the first case? so since she have a valid greencard, does she need to apply for a u.s.visa again? from what I understand, the u.s visa is just temporary till you get your green card so you can travel, work in the USA. if she doesn't need a u.s. visa, what should I do with the expired visa? Can she still apply for a valid u.s. visa using her green card, social security card etc?

seems like the "VISA" you are talking about is a green card stamp she have in her indian passport, but after coming to US she got her card that means the so call "VISA" = Green Card stamp is irrelevant. Please use only your green card to travel but make sure she is back in US in time so that she can have her green card renew or start process of removal condition. Please forget about VISA. Do not say US visa.

She is a green card holder and she does not i repeat does not need any kind of visa to travel to US.

thanks everybody for making it clear. so she does not even need to apply for an american visa since she have a greencard. looks like we're cleared to go to India and back.

I give this advice with the outmost sincerity, perhaps you should go back and do a refresher on the immigration journey so you can relearn all the steps all over again.

One of the core reason or maybe benefit of family based immigration is so that we can travel in and out at ease without needing any visa.

I just want to make sure that you're on top of everything so you don't miss a critical step.

The whole point of getting a Green Card is not to have to be dependent on maintaining legal status in the United States via any non immigrant visas like H1, L1, B1 visitor, etc. Once you have a Green Card, you are a LEGAL PERMANENT RESIDENT which allows you to live in the United States, work, and reside. Just make sure you are back to the US within less than 6 months after you leave because she will lose her residency status if you are out of the country for a longer period. And make sure you are back before the expiration date in Dec. And file the I-751 to remove conditions on her green card within 90 days before it expires, which would be sometime in Sep 2013.

The whole point of getting a Green Card is not to have to be dependent on maintaining legal status in the United States via any non immigrant visas like H1, L1, B1 visitor, etc.

Technically, a visa is not for maintaining legal status. A visa is only permission to come to the U.S. to apply for admission. After you enter the U.S., it is the I-94 that maintains your legal status.
