I am a male,European citizen who entered the country with visa waiver (ESTA) in 29th December 2011 and my visa expired in March 27th 2012.

I got married to my wife on January 6th 2012.

I am filing the i-485 now and i would like to ask you few questions.

1. In part 2 they ask me to say the reason that i am applying for permanent residence status. What should i say?

2. What should i put in the sections: nonimmigrant visa number, consulate where visa was issued and dste visa issued?

3. When they ask me for A# what should i put?

4. In Part3 in question 15 they ask if i have ever been in the army or other organizations. I have been so i should say yes right?

Also they ask me for the I-765 code for who may file. Where do i get this code?

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

nonimmigrant visa number: The red number on your visa at the bottom right

consulate where visa was issued and dste visa issued: this is where you applied for your visa and date issued is also listed on your visa.

3. When they ask me for A# what should i put?

You will receive one after your application is processed just write N/A.

4. In Part3 in question 15 they ask if i have ever been in the army or other organizations. I have been so i should say yes right?

Yes list your experience in the army location and period you were a member.

I am married to a us Citizen but due to health issues she did not make more than 9700 in the last 3 years so we need a sponsor.

I have a list with everything i need for my sponsor to sponsor me.

I have all the papers below,so i am asking is there anything more that i need from my sponsor?

I only have 1 sponsor. No co sponsors.

Thank you in advance.

1. Proof of U.S. Citizenship;

2. Three recent paycheck stubs;

3. The Federal tax return for the most recent tax year (2010)(please send us a copy of 2008 if available);

4. Most recent W-2 form for 2011 (please send 2010 and 2009 if available);

5. Employment verification letter (A sample letter is attached).

your spouse is ALWAYS the main sponsor, if she does not meet the income requirements then you need a joint sponsor. She needs to submit an I-864 affidavit of support along with supporting documents. The joint sponsor needs to do the same.

You need current information from 2011, 2010, and 2009. They ask for at least three months of payroll stubs.

your spouse is ALWAYS the main sponsor, if she does not meet the income requirements then you need a joint sponsor. She needs to submit an I-864 affidavit of support along with supporting documents. The joint sponsor needs to do the same.

My wife she has not filed taxes for the last 3 years at all.

There is a law that exempts her.

What do i do in this situation? I have the law printed and also she wrote a statement that explains why she has not filed taxes.

Does she have to file affidavit of support without submiting taxes?

If she is exempted as you say, I think she still needs to fill out the AOS with a statement explaining her exemtion and include the rest of what the joint sponsor submits.

If she was legally required to file, then she needs to file her back taxes before filling out the I-864. If she was not legally required to file those years, then she needs to include a statement as to why she was not legally obligated to file during those years, such as having an income so low she was not required by the IRS to file. She will need to have enough current income for your household size to be able to sponsor you at 125% of the poverty level. If not, she will need to find a joint sponsor.
