Returned k-1 petitions to VSC

So, after 2 years of our k-1 petition being returned to the VSC they finally decided to acknowledge my withdrawal letter from one year ago. I found it a bit amusing how they worded their reply.

Dear Sir/Madam:

On October 22, 2010, USCIS approved the petition for Alien Fiance that you filed on June 30, 2010, and notified the U.S consulate at Casablanca, Morocco.

It has now come to the attention of USCIS that you wish to withdraw this fiance petition. (REALLY , FINALLY??? I SENT THE LETTER IN JANUARY OF 2012!)

USCIS also notes that the original validity dates have now passed. This action is without prejudice to the filing of any future petitions or applications. ( WOULD HAVE BEEN NICE IF THEY HAD SAID THAT WHEN THE PETITION WAS RETURNED IN MARCH 2011 , INSTEAD OF SAYING IT WAS IN REVIEW WITH A LETTER DATED FROM MARCH 2011)

The record indicates that you married the beneficiary on March 8, 2012. Therefore the beneficiary cannot be classified as your fiance for Immigration purposes. WELL....DUH!!!! THAT IS WHY I SENT YOU THE LETTER TO WITHDRAW THE FIANCE PETITION.

The application of your petition is automatically terminated under Title 8 Code of Federal Regulations, section 214.2 (k)

So folks , this is the reason I'm posting you this letter , I have seen many, many people posting questions as to what happens to your returned k-1's . I have seen a lot of advice for people to wait for a review , that sometimes they reaffirm. I wouldn't count on it.

This is what happens to your k-1's that are returned to VSC. Interview date was December 2010, finally a letter today March 2, 2013 saying it's expired anyway and not valid because we married .

Hope this helps some of you who are wondering what to do next.

I never received any notice from our first k1, I refiled 3 years later and he's now here with me. They really amaze me.

01/2006 - Filed k1(1st time)

04/2006 - Interview (1st time) denied

Waited, waited...... no review

06/2009 - Filed k1 (2nd time)

09/2009 - NOA 2 approved

12/2009 - Interview (2nd time) APPROVED! VISA ISSUED

02/2010 - Arrived USA

04/2010 - Married

AOS Timeline

4/19/2010-Sent to Chicago Lockbox

4/26/2010-Received texts and emails 7th day

4/30/2010-Received NOA's(Hardcopies) 11th day

5/3/2010-Received ASC appointment notice(mailed 4/29/2010)14th day

5/7/2010-Walk-in Biometrics done(2 weeks earlier)18th day

5/13/2010-Case transferred to CSC

6/2/2010- Case received/resumed at CSC

6/18,6/22,6/23 AOS touches

6/28/2010- EAD production and touch on AP

6/29/2010-AOS APPROVED

7/2/2010- 2nd update on EAD production and touched on AP....

7/6/2010- Received "Welcome Letter" and AP document

7/12/2010-Received GREEN CARD and EAD

Wow, 3 years ! You two are very patient :)

We had our moments lol, but we made it. It actually made a difference in our relationship for the best. It's now 8 years since we first met and no regrets. Our visa journey is almost done and I can't wait for the finish line! Your time will come soon, just enjoy it while you can. The fun begins when they get here, at least 1 year adjustment. That's when you pray for patience laughing.gif

Thanks for sharing. We sent a letter to VSC at the end of October of 2012 to withdraw the I-129F and we had NVC send it back to them, and we've still not heard anything, despite having filed an I-130 and now having an approved I-130. Maybe in 2014 they'll get back to us. :rofl:

3/2/18  E-filed N-400 under 5 year rule

3/26/18 Biometrics

7/2019-12/2019 (Yes, 16- 21 months) Estimated time to interview MSP office.

I have heard that time and again, to enjoy the time I have before he arrives. Its hard to do that! I know I will need tons of patience when he arrives, and that it will be a big adjustment for him and me :unsure:. We have been going through this process since we filed on June 30, 2010 as you saw from the letter, and we've built a strong relationship over these past years. We are the better for it. Here we are almost June again 3 yrs later and we are married. We will be celebrating our first wedding anniversary apart while waiting for his interview. Hopefully our last anniversary apart! I will begin praying for patience now and when he comes hopefully it will be granted :rofl:

I bet because you also just were approved your I-130 that you will receive the same letter. Its a bit weird that they can't acknowledge the withdrawal letter until that time. Maybe its not worth their effort, but its a bit silly to send a letter after to tell you what you already know! Save yourself the postage USCIS and use that money to hire more adjudicators!

Also, congratulations on your petition approval!
