Leonid and Alla's ROC was approved on 2/27/2013 and GC production has been ordered.

No interview; piece of cake.

So......she can file for Naturalization within 90 days prior to the date on her first GC?

Yes, probably just a few months after you get the 10 year green card. :blush:

90 days prior to the 3rd anniversary of the first green card. ie. Alla's first green card was issued 1/15/2009 and we filed for citizenship October 20, 2011. She got her 10 year green card in March 2011. Her citizenship was approved February 1, 2012 just 15 days after she became eligible. So the sooner you file the better. Just make sure you do not file MORE than 90 days before or they will reject it.

And remember she cannot make a claim to be a citizen until she takes the OATH. Even after approved in the interview, she is not a citizen until she takes the OATH and receives her certificate.

Leonid will become a citizen automatically when Alla does. He will use his adoption papers and HER citizenship certificate to get a passport. His passport will be his proof of citizenship.

If you ever want a citizenship certificate for him, it costs $600 and is received by filing an N-600. He can file an N-600 at any time in his life, or he does not have to.

Tnx, she files the N-400 and there is no mention of him? Or the N-600, I haven't really done much homework in this regard yet.

The N-400 asks the names of ALL children. It specifically states even step-children. If you have any children from a previous marriage, they get listed also. Their status will be "US Citizen"

Other than that, there is nothing needed for Leonid. ALL children of a US citizen, under age 18, are also US citizens. Including adopted children. If he were over 18 (as Sergey was) then he has to wait until he is an LPR for 5 years.

When she has her US passport, the next time she goes to Russia, book a layover somewhere she always wanted to visit. Alla says the best part of being a US citizen is being able to go to other countries with no visa! :)

OK, then once she takes her oath and receives her citizenship papers, what is needed for Leonid to obtain his passport?

Take her citizenship certificate, Leonid's adoption papers (translated) and they may also need his birth certificate, I would bring it, (we needed it for Pasha because it showed Alla as his mother, your case is different, but bring it anyway) but the important document is the adoption paper that makes her is adopted mother. He will also need to turn in his green card when he applies for the passport. They will KEEP all the original documents and return them to you (except the green card) I know, that part concerned me also, but they DID return everything.

Alla will need her citizenship certificate and, as I recall, that is it. My Alla also had a name change certificate, but that is not an issue for you. Alla will turn in her green card(s), AP and EAD (if any) at the citizenship ceremony. Leonid will turn his in when he applies for a passport.

When she takes the oath, he also becomes a citizen.
