Highly likely to be denied entry--as marriage to a USC is a "red flag" of immigrant intent in the eyes of USCIS. :(

I think she has an excellent chance of getting a tourist visa to visit. She has very strong ties to Panama--her USC husband lives there. Bring evidence of your continued employment and domicile in Panama to the visa interview.

I disagree...many USC live with their non USC spouses outside the US and both make regular visits to the US... Can you immagine the uproar if most of them would be denied those visits?

At the POE, the key word is intent. If Dannybob just lost his job and is going to the US to look for a new one, and his spouse packed just about everything she could... what should an officer think? Or, in case where both are having life in Panama and things to return to...

I would not worry quite yet about being denied entry at a POE because without a visa she cannot even attempt to enter. I think the first hurdle is convincing the CO and getting a tourist visa. Good Luck!

My husband and I lived in Japan and I visited the US many times with my tourist visa. If you both are residents of Panama and she is just visiting the US with you, you'll have no problem.

Once we filed my immigration petition though...then I had a hard time getting in and I can only go back now with my CR1 visa in hand!
