I recently heard that people who are unemployed, but do have co-sponsors, are getting denied lately. I had a job with Wal-Mart from the beginning of November to mid-December in 2012, but have come across hard times with employment lately. I've been unemployed since December, but I do have co-sponsors and I kept my pay stubs from that time. I suspect my NOA2 will come any time soon, since I filed in July. Is there any chance of still being approved while unemployed in my case, or am I out of luck? Thanks for any replies.

I think it might depend on what country your fiance is from.

Hopefully you'll get a new job any day now, how else would you support your fiance once he/she gets here?

Well, my co-sponsors would be able to support her until I get employed. It's just that I spent a lot of money already and would hate to see it all go to waste, because my government so suddenly decides I can't have her come here. She is from Indonesia, by the way. I just have a limited time frame to work with now. I have to get a job very soon or face the possibility of being denied, so I'm a bit frustrated now. But yes, I do plan on getting a job as soon as somebody will hire me; that's just an unknown when I will be hired.

Are you married? Did you do a K1? What country is the benifiacry from? We can better answer your question if we know this information.

Edit: sorry just noticed this was in K1 area so it looks like you are doing a k1. Now it depends on the country the benificary is from, some countries you can and some you cannot or very hard to do it.

11-08-2011 Date on text messages but did not receive until 11-22-2011

11-23-2011 Check cashed.

11-25-2011 Hard copies of NOA1s

12-06-2012 Pui's Brother unexpectly passes away and we make an info pass appointment and receive an emergancy AP so she can return home. Pui leaves for Thailand for 2 weeks.

12-06-2012 Get a text message and email that she received an RFE

12-12-2012 RFE for original birth certificate. I swear we sent it along with a certificate translation of it.

12-20-2012 Pui returns from Thailand.

12-21-2012 We send the RFE back for with original birth certificate along with a new certificate of translation(I had to wait for her to return for her to sign)

12-26-2012 text and email they have received the RFE.

12-29-2012 Appointment for biometrics is 01-23-2012

01-13-2012 AP is approved.

01-23-2012 Biometrics appointment. Later during the evening the text and email saying the EAD is approved.

01-31-2012 EAD/AP combo card arrives.

05-22-2012 Email and text card is in production!

The government did not suddenly decide anything. The rules haven't changed.

You need to provide proof of income - as mentioned, how are you going to support her when she gets here? Co-sponsors (If a fiance visa and allowed in that country) are for government coverage - not her everyday living expenses. Unless you worked out some kind of plan with them.

I think you hit the nail on the head - keep looking for work, full time, eight hours a day and I am sure you can come up with a job soon.

When a prospective immigrant is in front of the CO the CO must determine that they think the person is unlikely to become a public charge. A number of factors are considered. What is your job history, have you spent your life mostly employed or have you been collecting welfare for the past 20 years, if presenting co sponsors are they likely to help if needed ( more probably for close relatives than a more removed co sponsor) If the CO is happy then a visa is issued. Same rules everywhere. If you have lived on welfare and present a disconnected co sponsor you will probably be denied. If you are out of work but have decent work history it will improve your chances

This will not be over quickly. You will not enjoy this.

I've helped out at my dad's business for free for many years and I've volunteered for another business. As for paying jobs, I have only had those 1.5 months working part time for Wal-mart and I've kept the pay stubs. It's something, at least. I hope to get work with them again soon, since I'm on their "hire list" when they start hiring employees again. It's just that you can never know when that will happen.

the government didn't' "suddenly" decide that she can;t come here. You petitioned for her, she will be your responsibility you need to prove you can support her, this has always been the case. The government doesn't want people to immigrate here and become a public charge. I'm curious as to why you are blaming the government?
