help,. im so confused of what they mean by "if you are applying based on five years as a lawful permanent resident or based on three years as a lawful permanent resident married to a US citizen, you may apply for naturalization up to 90 days before you meet the "continous residence" requirement. You must meet all the requirements at the time that you file your application with USCIS"

i am filing under my marriage, 6 years of marriage but only 4 years of residency since i got my gc 12/04/2008.. does that mean i missed the filing under 3 years of marriage and have to wait for 5 year anniversary of residency before filing? im so worried that i may not able to file my citizenship because ive already gathered all documents and ready for submission until i read that part. Anyway i will have to call uscis tomorrow, but i wanna know if somebody experience this situation? to be honest i cannot wait for 1 more year of waiting because i want to petition my mom once i get my citizenship.Please enlighten me.

No, you didnt miss. Whatever they said, that is the minimum requirement before one can be qualified to apply for N-400 based on marriage. You are good to apply N-400 based on marriage with USC.

You are qualified to apply as a spouse of a us citizen (3 year rule). i'm in a similar situation. i even asked an immigration lawyer about it and she said that it doesnt matter for how long u have been a resident. all that matters to apply as a spouse of a us citizen is that u reside continuously in the states and be married to the same us citizen during the three years preceding the application for naturalization.

If you can't change your mind, are you sure you still have one?

You missed the earliest date you could have filed. That date was the third anniversary of your residency, as listed in front of your Green Card. You now can apply tomorrow, next year, 10 years from now, or 200 years from now. There is no deadline to meet. Your ability to naturalize ends when you die.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Act of a 1927 congress, you will be a better citizen if married to a US citizen, so the three year is a privilege only offered to an immigrant that is married to a US citizen that permits you to become a US citizen up to two years sooner, than others that came here say by winning the lottery or a work visa.

You have to be married to a US citizen at least three years before can even send in the N-400 application, and no sooner than 90 days before your 3rd green card anniversary. You do not have to take this privilege, but does come with a price, like proving you are and have been married to this US citizen with tax returns, joint residence, and joint just about everything else that has some sort of a legal document.

This privilege is only good up to 90 days before your 5th green card anniversary, so as a married to a US citizen, could apply say 91 days before hand, but would have to provide proof of your marriage and lots of it. But If you wait until 90 days before your 5th green card anniversary, none of that marriage proof is necessary. Just your application, check, green card, and two passport photos is all you need to send in. You will also find it much easier to fill out the N-400 because is base primarily on the standard five year.

Ha, one thing I thought my wife in a big hurry about our strict laws, she came from a country where stop and speed signs were non-existent, and couldn't understand with our super highways, we could only drive, 25, 35, 45, 55, or as fast as 65 mph, or whatever that speed limit sign said, and stop means stop, like parked for a couple of seconds at least. If she came here single living alone, she wouldn't know that. Didn't ,make any sense to her with our beautiful roads, we had to drive so slow. Come to think of it, doesn't make any sense to me either. But its the law. This is only one thing, another are our tax laws, she doesn't understand why we have over a thousand different tax laws, or why she should vote when most of the candidates are running unopposed.

You can see by being married to a US citizen, that citizen can explain stuff like this to a new comer. So she will become a better citizen sooner.

you should be okay.. i've ben married for 6 years tomorrow and filed under the 3 year rule last year.. don't wait like me and go ahead and file your n400
