Hi. I petitioned my wife through K1 visa. When I filed the I-129F my stepson's name was included but that was almost 3 years ago. Now I would like to petition my stepson to come here in the U.S. From what I've read so far, I will need to file for I-130. Is this correct? What other paperwork I need to do? What other documents do I need to turn in? Thanks for your time. :yes:

when your wife received her green card she had one year to petition for her son or daughter she missed the opportunity,so now she has to petition her son or daughter 1-130 if over 21 unmarried it will take long time, if under 21 then it' a child take to the consulate in that country,

She has to do it as you cannot file for a stepson. It will be faster if she gets her citizenship.

About how long will it take if she petition him as a green card holder? She wont be able to file for citizenship until the end of the year. We was hoping to get him here before the end of the year. Thanks for tour time

That is wrong. It is easier for him to file the I-130 for his stepson. Approval is quicker since he is a citizen. My husband filed the I-130 for my 2 kids and only took 6 months for the whole process.

The best way is u the US citizen will file the I-130 for ur stepson. Your wife don't need to wait to be a citizen to file for her child,,she can even file now for her son but it is best for u to file. My husband filed the I 130 for my 2 minor kids and only took 6 months for the whole process.

He was only 8. He's 10 now.

The quickest way is for the US citizen stepparent to file. This would take 6-12 months.

You may follow this link for your stepson's case. Yes, you need the I-130...along with some other NSO civil documents (birth, marriage).

Thanks for all your replies. I greatly appreciate all your help. I was just reading all the info and instructions for I-130 and I just have one last question. Below are the other documents I need to submit along with the form I-130. I have #1 and #2. But dont have #3 since my wife was never married to my stepson's biological father. They pretty much part ways right after my stepson was born. If I just submit #1 and #2 would that be sufficient? Thanks

Step-parent (step-mother or step-father)

1 A copy of your step-child’s birth certificate issued by civil authorities

2 A copy of your civil marriage certificate to your step-child’s biological parent

3 Proof of the legal termination of all previous marriages for you and/or the biological parent (divorce decree, death certificate, annulment decree)

Well, you answer definitively without assertaing the child's age.

You could have given an answer that covered a stepchild if the marriage occurred before or after the child's 18th birthday.

Instead you choose to give a definitive answer that covered the incorrect scenario.
