The Senate's 28-19 vote in support of Gov. Martin O'Malley's bill came after more than 12 hours of often-emotional debate Wednesday and Thursday. Supporters said the proposal — which would ban the sale of assault-type rifles and require a license to purchase a handgun — would save lives.

"You can get a gun quicker than you can get an apple or an orange in my community," said Sen. Nathaniel J. McFadden, a Baltimore Democrat. "It's an outrage, and we need to do something about it."

Opponents said virtually the entire measure treads on Second Amendment rights but objected especially to a licensing provision that would require citizens to give their fingerprints to police in order to purchase a handgun.

"This is a right. You certainly wouldn't be expected to be fingerprinted to go to church," said Sen. E.J. Pipkin, an Eastern Shore Republican.

I guess Beretta is relocating to another state, didn't they make that claim?

Beretta, (gun maker) has a pretty big foot print in that state but it makes no sense to stay in a state which is so quick to ban it's products.

And Md. is not exactly the industrial hub it once was so it will hurt a large number of employees and ancillary jobs and under this Obama economy, not sure what replacement work they will find.

Ahh you do know in a dry county you can still drink all the JD you want?

You can still posses all the whisky you want.

You can even home brew all you want.

The only thing a dry county regulates is business.

In MD, they're looking to ban the sale of assault-type rifles even though they are produced there. In Moore county they ban the sale of whiskey even though it is produced there. So what?

Title 39 - Criminal Offenses

Chapter 17 - Offenses Against Public Health, Safety and Welfare

Part 7 - Intoxicating Liquors

39-17-707. Possession of still.

(a) It is unlawful for any person to have possession or control of any still or other apparatus, or part of any still or other apparatus, used or intended to be used for the purpose of manufacturing intoxicating liquor as prohibited by law.

(b) A violation of this section is a Class B misdemeanor.

[Acts 1989, ch. 591, § 1.]

39-17-708. Home manufacture of wine or beer excepted.

(a) Notwithstanding the provisions of this part, a private individual in the person's own home may manufacture and possess wine or beer in an amount not in excess of that amount annually permitted as of January 1, 1997, by federal statutes and regulations relative to household manufacture and consumption; provided, that the wine or beer is for personal consumption by members and guests of the household. Such wine or beer may also be transported by the person, member or guest without being in violation of this part; provided, that the amount being transported at any one (1) time shall not exceed five (5) gallons.

(b) It shall be inferred that transportation of more than five (5) gallons is for the purpose of resale or redistribution.

(c ) For purposes of this section, "beer" means the undistilled and unfortified product, of any name or description, of the normal alcoholic fermentation of malt or other ingredients except grapes.

The maximum amount of homebrew beer that may be produced without tax per annum is 100 gallons per individual, or 200 gallons per household if there are two or more adults in the household. This is regulated federally. 27 CFR 25.205 - Production.

I had a hunch, so I asked my homebrewing Tennesseean boyfriend what the case was. He said that he had to be careful to only bring 5 gallon carboys over to friends' houses just in case he got stopped by the po-po on his way over.

Maybe I overstated the case :blush:

You probably can't moonshine all you want but you can own all the "taxed" liquor you want.

The Homebrewer from Tn, is not so much limited by the "dry county" as he is by the feds I suspect.

Doesn't matter if you are in a dry county or not.. you can't do more than personal consumption off a still.

Any VJ-home brewers up on the law?
