To keep this short, is this legit?

My girl came to US first time ever under vwp in jan for 2 weeks. Shes coming again in july vwp for 8 weeks. Can she get a b2 visa and come again in nov/dec? Then lets say a couple months into the b2 visa stay we want to get married. Can we get married then do AOS and bypass k1 all together?

It is called immigration fraud. If you are found guilty of it, the results are denial, deportation and a lifetime ban.

People who have successfully AOS'd have usually done so without intent and "change of circumstances". As you are planning, you are planning immigration fraud.

It is also against the VJ TOS to give advice about immigration fraud.

You can get married, no problem. People get married on tourist visas all the time. There is no law against it.

You cannot AOS to "bypass immigration laws" however - It's called immigration fraud and carries a penalty of deportation and lifetime bar from re-entry if found guilty of it. AOS exists for those who decide after entry to AOS. For example, a student who arrived in the US on an F-1 visa in 2005, and got married in 2007 could not have been expected in 2005 to know he/she would get married 2 years later. It is also possible for tourists, but again, you'd have to have decided after entry to go through with an AOS - otherwise it's fraud.

She can get a B-2 visa even if she is from a VWP country - But why apply for a visa if she can use the VWP?
