Hey guys - I am US Citizen, my wife is Guatemalteca. We went yesterday for the I465 interview, and the representative was nice, but was very adamant that my wife should not be married at such a young age (20) - (I'm 28). We went through the interview process and I think it went very well, however we did not receive a YES or NO answer. We received the response "If approved, you will receive your card in 4-6 weeks". Additionally, she wrote in red ink "Cancelled" on my wife's US Visa. There is still no update on our case, online. Should we be concerned?

I do not think you should be. The officers are free to express their opinion during interviews but unless it has a good bearing on your case, they cannot use it gainst you.

I received a case update yesterday afternoon, they approved the I-130!! :)

However the I-485 still shows a status of testing and interview, so I'm a little confused. What is left to the process? Will there be another interview for the I-485, will they continue with the case and approve/deny it, or is there simply no chance it would be denied since the I-130 was approved?

It really pisses me off when someone decides to pitch in on such a personal subject as deciding to get married. If you had wanted their opinion I'm sure you would have asked for it. They had one function at your interview and that was to evaluate its legitimacy, not to pontificate on whether your wife should have gotten married or not.

You will probably receive the I-485 approval within the next few days.

I agree, I was a bit irritated but what could I say to her... If I'm rude to her in the slightest way, she could just deny the application and be done with us. Obviously we could appeal her decision, but we would love to be done with immigration for a while!

I haven't updated this topic in a while. Primarily, because I have still heard nothing on our case. sad.png

I have followed up with USCIS twice so far, and the only thing they can tell me, is the same thing I see on the website. "Hartford is still working on applications filed in September; call back in 30-60 days" (we filed in November '12). seems like a very generic response to me, but what else can we do. That status was last updated on the website on April 30. I see people on VJ that filed after we did, in our area (Hartford local office), that already have everything completed.

The case was last updated on Jan 24th:

The biggest problem is that we are planning to travel to Guatemala in December to visit her parents for Christmas, but we can't buy the tickets yet - and I can tell you, the price isn't going down! If there's a problem with my case, I would like to know so that I can resolve it ASAP, but they aren't giving me any information. Is there anything we can do?

OMG, can't believe its been nearly 5 months past your interview date!!! That's horrific. Have you tried making Infopass appointment? I think being pending for that long is not considered normal. I think either an InfoPass appointment or even contacting your local Congressman / Senator are the right courses of action at this stage. I would not be surprised if your file is just sitting in a long forgotten corner. The processing dates on the websites are all total nonsense. Seems like to me the interviewing officer in your case just dropped the ball and forgot about you. I think the Infopass appointment ought to shed light on it again.

You don't have Advance Parole? Do you have overstay?

I see your I-130 was approved the day after your interview. That is highly unusual without the approval of the I-485 too. Usually they approve both or keep both pending. I wonder if you were meant to be approved but that button didn't get pushed.

You say you followed up with USCIS, but it seems like you called them on the phone? The phone people can't do anything. Make an INFOPASS and talk to them in person.

If you are in AP there is nothing you can do, but it might be a case of forgetting to push the approval button. Good luck.

I see your I-130 was approved the day after your interview. That is highly unusual without the approval of the I-485 too. Usually they approve both or keep both pending. I wonder if you were meant to be approved but that button didn't get pushed.

You say you followed up with USCIS, but it seems like you called them on the phone? The phone people can't do anything. Make an INFOPASS and talk to them in person.

Unfortunately we didn't do Advanced Parole because we didn't have the need to leave the country at the time, and research indicated that everything would be taken care of within ~4 months of filing, which based on the appointment time and what we were told by the USCIS officer during our interview, would have been. sad.png She did overstay her Tourist Visa, but we were married before it became an overstay and filed ~7 months after we married.

Thanks for the information! I had no idea you could make an appointment, or I would have a month or two ago. Going to make an InfoPass appointment now!! Do you know if I can choose the date, or if one is assigned to us, how far out it would be and what information we should take with us when we go?

'Morning guys!

So, we went to Hartford yesterday. Pretty smooth process, we were trying to be a bit early - good thing, because we hit traffic a couple times and ended up arriving just 10 mins before the scheduled time, went through security and passed the counter 5 minutes before our scheduled time... We got our number and had a seat. @ ~2:35 we were called up to talk to an officer. We gave our appointment paper and ID's, and he asked what we needed. While I explained, he pulled up our case based on the receipt number I added to the InfoPass request. He told me that there has been a decision made on it, and it was sent to the National Records Center, but the decision wasn't put into the computer. Because of that, he has to request the case be sent back to Hartford to see the case status - and we have to return in 2-3 weeks (I'm not sure exactly why we have to return) - he also took down my phone #, so maybe he will call with the status? no clue

I have high hopes that it was approved. I talked with one of my friends about it, who has been through the process and he told me that it had to be approved because if not, it would have stayed in Hartford and they would have requested additional information or sent a denial, etc... I just hope it doesn't get "lost" in transit!

Striker_Immig - From your sig, it sounds like you were approved - so probably a similar situation to ours! When is your InfoPass appointment?
