Hi, Friends

I need some advice on this,

I am going to apply for USA citizenship soon, i have my parents and brother in india my brother is under 21 but i read articles that siblings cannot be applied on with mother and father and they have to be applied on F4 category. So by reading those articles i understood that i cannot apply I-130 for my brother with my mother father and it will take 10 years long process. Is there any other way to bring my brother as dependent to my father mother along with them when i apply for them ?

Also futher to add, my mother , father and brother has green card but they didn't come back to stay in united states and it expires in 2016 and they been out of USA for more then 5 years so they cannot enter on that green card but they still posses it and it's not expired.

What should i do in this scenario ?

Should i along with my brother fly to Canada as he also has green card and then enter usa via road.

My brother's green card expire in 2016 and as he cannot enter usa because he stayed out of usa for more than 5 years but he can enter canada as he has green card in possession.

Your brother cannot be a dependent in the petition for your parent. You need to file for him separately. It's 12 years for him.

If you would like to commit a federal crime and go to jail, then sure you can smuggle your brother across the border in your car. Bad idea.

How about doing things the legal way?

If your brother is so young he needs a parent with him (maybe boarding school is an option? Or staying with a family member?), then you can either petition for him now, then petition for the parents when his priority date is almost here in about ten years, or petition for one of your parents, who then comes here and petitions for their minor child (takes about 2.5 years, depending on country) and you petition for your other parent.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
