Just got an email few hours ago indicating they are missing copies of my 2012 tax return. Called NVC right away & told the rep it's not due yet & I have not filed it yet! He told me to do another I-864 & resend. All other documents are clear. By the way I did send 2011,2010,2009 & mountains of evidence/paperwork. My wife was denied once when I applied her as fiance(I-129F) without any reason. We had everything you can think of, pictures, traveling to multiple foreign countries together, plane tickets, hotel stays you name it. I personally attended the interview and visa officer asked me all the questions. Everything went fine with so many evidence I gave I never thought she would be denied visa. At the end when he said he can not issue visa, I had almost heart attack. I kept asking why, what's the reason. He would not give me one other than to wait for answer from USCIS which never came. Only reason he gave after pressing, he has reason to believe it's not a bonafide relationship!! But would not give the reason! She even went to my native country twice(3 times now after marriage) to meet my family & parents & we even had engagement ceremonies there as well. Well we got married later on,visited many different places, countries you name it but now I am not so certain until she gets visa. Here are some reason I can see for her denial but those are discriminatory. I am not same race as her. My origin is not from her country. Though I am not a religious person, we are not same religion. We have 17 years age difference. Both of us married before & I have 2 children.

But we are madly in love with each other & I have visited her 7 times in 2 years! Nothing can stop us! We just spent whole month of January in Malaysia, Bangladesh(My native country where my parents live) & everywhere in her native country Cambodia including Siem Reap. I am prepared to visit her again in a month or so as soon as she is called for interview & this time I am bringing her with me or I am staying there myself.

Well I just want to tell you be strong and brave. Keep on believing, most people would give up, so keep going and continue fighting for your love. With all that mountains of evidences, photos and multiple times of meetings and visits. You have a lot stronger case than most relationships. They can't denied you on that basis. You would think that they believe you by now. Don't ever give them a reason not to believe in you. Hang in there. It seems like sometime their bias and discrimination gets to you, but just hang in there. It's not how many time you fall it's how many time you get back up. Let them know you have solid evidences of a bonafide relationship with all those visits. Tell them you are committed to this relationship for the good and bad. Let them know how much you love your spouse. As far as 2012 tax return I filed it and give a copy to your spouse to bring with her to the interview. Incase they ask for it which is most likely. While NVC may grant you case without without the 2012 tax papers, the consular officer may be adamnt to see them so be prepared. I would suggest you file them now and have her go with it to her interview. I intend to do the same for my husband. I was hoping we get an early interview that is not close to april so we can escape that as I hate paperwork but as the days draw closer without a date yet, I have to go get them ready.

Hi NikaMo! I am sure you will not face any problems this time around :) Just stay positive!

I understand filing the 2012 return might be a pain at the moment, but it won't hurt to try to do it as soon as possible. If you do it now, you can send it with your I-864; if not, the embassy is likely to still ask your wife for it during the interview:

IF a sponsor filed an I-864 (Affidavit of Support) AND provided the NVC with proof of an IRS Federal Income Tax Extension in lieu of a Federal Income Tax Return, the applicant must bring the sponsor's most recent Federal Income Tax Return to the visa interview.

Thank you very much all of you. Forgot to mention when her I-129F was denied on Sept 21, 2011, I contacted my congressman and 2 senators of my state(Georgia). Both of the senators are very influential ones, one of them in the senate armed forces committee. They all contacted US Embassy in Phnom Penh on behalf of me(I wasn't expecting a quick response from them!). But I guess it was too late. Embassy replied to them right away that they sent the case back to USCIS & have no access to it anymore. They kept in touch & assured me they will help any way they can. Should I contact them this time before interview? I just received a letter from USCIS(Finally) that my old case(I-129F) expired & they are closing that case. They indicated that this will not affect any future case. Also in the letter they noted that they do have a I-130 case for the same beneficiary which was approved by them on January 16,2013

I thought everything was done! Now they are asking her Police report! Last time she took it the day of interview. All this time I knew it was the day of interview. Now NVC requesting it. They are also requesting all original certificates like Marriage certificate, birth certificate, Divorce decree(Both of us). I sent all certified copies when I originally applied with I-130. My understanding they need originals the day of interview. Why all of a sudden they are requesting all originals? What happens they loose any of them? They said they will give them back to her the day of interview. I left all originals with her in Cambodia on my visit last month for interview preparation. Now need to DHL back. Is this something new just started?

Sorry you misunderstood. Originals have always been required at NVC. Not at USCIS they do not even ask foe originals of anything. sorry you'll have to get all that together originals or certified copy of he original.
