I think I may have received wrong advice and afraid it may be too late.

I filed for my parents after I became USC. Their petition was approved and they will be here next week. I did not file for my brother and sister since I was told it would be faster for my parents to bring them over. Sister is over 21 and married and brother is 20 unmarried.

Is it too late? Should I file for my brother (I-130) or let my parents file (I-130). Or is there any other process for them to bring my brother with them.

If you file for a sibling of any age it is about 12 years to wait.

If your parents file, both your siblings will probably be over 21 by the time they are able to get a visa however your parents can't file for a married daughter over 21 unil they are US citizens ( at least 5 years before they can file ) They are surrently working Mar of 2005 for unmarried adult children. Once they become a USC the wait for a married child is 11 years.

So file for your sister , it will be quicker ( she can be married ) if money isn't a thing file for your brother as back up and have your parents file and hope it processes quickly.

This will not be over quickly. You will not enjoy this.

File for both if you can. It's 12 years for both. Marriage does not matter.

An LPR cannot file for a married child, so your parents can not file for their married daughter.

Your LPR parent can file for your brother. By that time, he will be 21 so it's 8 years. He has to stay single. Marriage at anytime before he gets a green card permanently voids the petition.

I agree, file for both if you can, and when your parents get here they can file too- that way your siblings have two petitions going at the same time, just in case something happens to the parents.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Your mom as a LPR can petition your 12 y/o sister. It would take 2 + years. She doesn't need to wait until she becomes a US citizen. Which would take 5 years.

I didn't even know about that 2+ yrs time frame for an LPR to filed for <21 unmarried children.

What about the >21 unmarried children? how long will it takes for a LPR or USC?

If they are from the Philippines, unmarried kids over 21 of greencard holders; 11years waiting and of USC parents: 14.5 years (yep, the Phils is unusual in that USC wait longer).

Thanks everyone for the replies.

I am not worried about my 21+ sister but only about my brother who is under 21 at the moment.

If my parents file now will it take 10, 3, 2 or 1 year? What is the best way going forward? I file as USC now then once my parents are here and receive their GC then transfer the file to them?

You wouldn't tranfer the file ( they don't do that ) but you could file now and then when your parents get here one of them could file to get him here faster. If something happens to your parents then your petition is still there.

This will not be over quickly. You will not enjoy this.
