Hi all! After I get my citizenship, I'll be filing for my parents to become permanent residents. I know you have to file the I-130 but I came in on the K-1 route so I'm not familiar with that process. Can someone help me out here? I just want to make sure I understand the steps in the process and am asking my parents to gather the right documents.

1. File a form I-130 for each of my parents (me)

  • My birth certificate
  • My passport or naturalization certificate
  • Parents' marriage certificate

2. Once a visa number is issued, they will be called into the local embassy for an interview and visa issuance.

3. They move here

4. Go through AOS process

File form I-485 for each parent (parents do this)

  • Birth certificates (parents)
  • Copy of passport page with non-immigrant visa (will get with I-130) (parents)
  • 2 US style passport photos (taken within 30 days of filing) (parents)

Include:

Form I-693 - Report of Medical Examination and Vaccination Record for each parent (sealed envelope)

  • gather Vaccination records (parents)

Form I-864 and Form I-864A for each parent (completed by husband and i)

  • Proof of citizenship - BC, passport or naturalization certificate (husband and I)
  • Proof of current employment and self employment (husband and I)
  • Copy of Federal income tax return, including W-2s and 1099s (husband and I)
  • (Can also submit this for last 3 tax years, last 6 months of pay stubs or employer letters)

5. Then we wait for biometrics, maybe and interview or better yet, green card in the mail.

Do I have the steps all right? When I applied as a K-1, I had to have my medical done in my home country prior to entry to the U.S. I also had to have a police clearance or background check done to take with me to the embassy interview. And I think I also needed an Affidavit of Support prior to moving here too. Is it different for this process or am I just missing stuff?

Thanks for helping me. The guides are great, but they aren't as detailed for bringing family members are they are for spousal or fiance visas. Oh, I know I haven't included the cheques on the checklist, but I know there are fees involved. Boy do I know that.

When you file an I130 there is no adjustment of status in the US. There are guides under the guides tab for what you have to do. Most of your documents are collected here and you pay an AOS fee while the petition is at NVC, they get a greencard after arriving and can travel right away

This will not be over quickly. You will not enjoy this.

So in fact, I am over thinking this. I have read the guides but though they detail what to include with the I-130 (my birth certificates and their marriage certificate) all it says in the 'After Filing Your Petition" section is "You will be notified by the USCIS if your I-130 petition is approved or denied. If it is approved and your parent is outside the U.S., your parent will be notified to go to the local U.S. consulate to complete his or her visa processing." So can you tell me what the 'visa processing' at the embassy is all about then? I know I'll have to complete an Affidavit of Support - when does all that happen.

Or.. I'm completely blind and it's actually in the guides. If so, can you help me out and provide the link?

Did you start here ? link One the I130 is approved it looks just like any other I 130 , you pay AOS at NVC, petition goes to the embassy, she has an interview, brings proof or relationship , her police certificate and has a medical.

It's not just you. Guides for IR-5 are far from complete.

That part confused me, too. Here is what I gathered from reading here, although we are still not at approval stage.

- USCIS lets you know of approval

- They send the case over to NVC, and it can take 1-2 weeks for NVC to get it.

- You call NVC after 10 or so days after approval to find out if they received it, to give them your and your parents' email addresses, and to get your NVC number and IIN number

- With those numbers, you can email Choice of Agent form DS-3032 (there is a special template here on VJ). Instead of emailing, you can wait for them to send your parents a hard-copy of it, they sign it, and then snail-mail it to you, or scan it and email it...all of that to me sounds like waste of time if you can email it. That is of course assuming you want to act as their agent. If not, you parents would later be sending all the documents to NVC themselves.

- Once NVC has your email, they will send you AOS Fee Bil. You pay it, wait (1-2 days) for the system to show it's PAID, and then you can download cover-sheet (I think that's the name) from that payment system site and send your I-864 with documents

- In parallel with NVC sending you I-864 bill, once they process DS-3032, they send you and your parents the IV Bill. You, as agent, pay this bill, once both I-864 is processed and IV Bill shows as paid, they send you DS-230 packet (also known as packet 3). I think they email you this.

- You, the agent, send DS-230 with all supported documents back to NVC. Your parents will need to send you signed part I of DS-230 and originals of all the documents needed for this stage. If they choose not to have an agent (they didn't appoint one on DS-3032), they would be the ones paying the IV bill, and sending DS-230 and the documents back to NVC.

- Once NVC receives and completes DS-230, they should notify you and your parents that the case is complete. Again, I've heard they don't always contact, but people call them after couple of weeks. NVC then works with the local embassy to figure out available dates for the interview, and they let your parents (and you?) know when the interview is scheduled.

- NVC then sends all your papers to the embassy. This can take another couple of weeks. I've heard some embassies open their packages from NVC only on certain weeks of the month, so it may take them longer to be ready with some cases.

- At this stage, I am not sure if the parents then wait for the embassy to contact them with the info about where they need to do their medical, or if they need to call. In any case, they need to receive info about the medical locations. The parents then schedule the medical with the special doctors from the list. They just need to do it some time before their interview date, I guess at least few days before, so that the doc has time to send the form back to the embassy.

- At the interview, they get a sealed envelope that they need to take with them and give to the officer at POE.

I hope this helps, but I hope someone who went through this process can correct if I missed something.

Yes, NigeriaorBust .. I did. As I said, little information is provided there on what happens at the embassy. I'm not new to VJ, but as I said, I'm new to the I-130 which is why I feel almost like I'm starting from scratch for this one.

Instead of emailing, you can wait for them to send your parents a hard-copy of it, they sign it, and then snail-mail it to you, or scan it and email it...

Just one correction, if parents are mailing the DS-3032, they would mail it to NVC, not to you, the petitioner.

I am petitioning my parents, So my husband will fill out the I-864A, and Im' confused about the Part 2 and 3 of the form. They were asking for a "number'. Since we are filing separate forms for both, Do we need to enter our parents name in 13a and b, And enter "2" for number in both section? Thanks

THE PROCESS WILL BE:

1) File your I 130 form to USCIS together with your payment thru Money Order (for other forms of payment check the USCIS website). Each parent should have a separate i-130 form. If they are currently in the US legally right now, this is the only time you have to file for their I-485 (Adjustment of Status). Therefore, you have to file i-130 and i-485 all at the same time to USCIS. But if they are not currently in the US, you have to file only for i-130 form.

2) If approved, they will inform you thru text, mail, or email (approval time for Immediate Relative Petitions takes around 2-7 months from the date of receipt). Then they will send it to National Visa Center (NVC) for visa processing. Sorry but I don't have idea for those who filed I-485 if they will be still sent to NVC.

3) Once NVC receives your approved petition from USCIS, they will send you a packet which includes forms like DS3032 forms (Choice of Agent/Address) and Affidavit of Support (AOS). Here you have the option if you will be the agent or your beneficiary. When you become the agent, you are responsible for any correspondence that will come from NVC. You just have to coordinate it with your parents (wherever they are currently residing) for the documents and signatures that will be requested on their end. NVC will give you checklist on what documents needed and the fees that will be paid.

If they are living outside US, NVC will send you instructions where to get their medical examinations. NVC will also send you when & where their interview will be held. It is normally the nearest US Embassy's local consulate office nearest to your parents country of residence. Medical exams should have been done before the interview. You have to send all the documents to your relatives before their Visa Interview and prepare them as well. Documents will be asked by the consul during their interview. Once approved , they will get their passport and issued their immigrant visa.

4) If their visas are on their hand, they can now fly to the US.

yes you need to include all the names of your relatives whom you are filing i130 form separately. if the form is for your father's petition, include your mother's name, your sister and your brother. same with the others.
