It is visa fraud for him to use his tourist visa to enter the country with the plan to stay/immigrate, which could lead to a lifetime ban (or at least a ban until he is an adult and removal of his tourist visa).

What you can do is file the immigration visa for him anytime- so file for him now, he can use his tourist visa to visit during processing, but must go home for the medical and interview.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I have a son (minor) I heard and watched that you could file the petition here in the US so long as he is here in the US and instead of applying the same from the country of origin. I would like to hear from you all about the process and requirements.

If you visit with the pre meditated intention of staying it is visa fraud.

We'd need more information about the case.

However, something word of mouth from someone who saw it on a talk show is not a very good source especially with something so important. :o

Remember to tell the CBP officer at the Point of Entry that your minor son is coming to USA to stay and adjust status.

Then let see if the officer will let your son into US or not. :whistle:

The talk show is wrong.

What do you think would happen at the POE when your child states he is using his NON-IMMIGRANT visitor visa to IMMIGRATE to the US? Denial of entry.
