Greetings everyone.

I am a European citizen. I came to the US in December 29th 2011 and i got married to my wife in January 6th 2012.

I came with Visa Wayver (ESTA)

We are filing papers now for my green card and i have 2 questions.

I do not have the Arrival/Departure Record (I-94)

What should i do?

You said you have 2 questions. What are your 2 questions? I only see one, and that too, not very specific. Also, the reason other members said that USCIS will think you committed visa fraud was because you came to the US on ESTA and then got married 8 days later. Marrying 8 days after you got here might seem fishy. Then again, it might not matter at all. Members are simply giving you a warning that this may be something you might want to watch out for, in case you did have the intention of coming to the US, then marrying to adjust. Make sense? people here are only trying t make you aware that coming here in the VWP with the intent to marry, stay and adjust status is fraud and carries a lifetime ban with no appeal. You are attacking those who are trying to help.

Don't worry, you will be fine, adjustments from VWP are regularly approved.

yes people who did not have intent to marry and adjust status are regularly approved, people who came and didn't plan ahead of time. The OP planned to marry and stay, totally different set of circumstances. You cannot plan to do this in advance, it's fraud, carries a lifetime ban with no appeal or waiver.

Dimitri? Please pay attention to what everyone is trying to tell you. You came into a great place to get help with VISA related issues and I think you are getting defensive without understanding what everyone is saying.

You said you've been to a lawyer when you came to the US. Fine, why come on a forum to ask about it if you already have expert advice?

I'm guessing it is because you have your doubts about what the lawyer told you.

Having said that, go and research what everyone is saying - Ask your "lawyer" about any problems you will face for having come into the US the way you did and getting married 8 days after arrival. See what his or her advice is and stop wasting your time getting irrelevant advice from people who clearly don't understand your unique situation.

But be advised, the advice they are trying to give you could help you stay in the US if you'll pay attention.

"It is not illegal i went to a lawyer when i came here. Cause i came Legal in the states i am ok. Plus Obama changed the Law and now i can adjust status from here. I just wanted to know what to pu in this blank. Everything more that that i think its irrelevant."

Exactly MIMOLICIOUS. I don't understand why people come on this site asking questions and looking for help and then get upset when they do not get the answer that they want.

If he has a lawyer, why is the lawyer not filling out his paperwork? Is the lawyer an immigration lawyer?

Hey guys I arrived on VWP, with the intent to marry, but not stay. I'm from oz and I'm heading back home next week however we are about to lodge whilst I'm onshore in California. My query is regarding qu C-14 there is a field that appears to want an 11 digit number. I've retrieved my I-94 details electronically however I don't know what number to populate in this field. Do you think it is just safer to hold off from lodging the I-130 until I'm back in oz or does it not matter seeing as though I'm leaving in a week..

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
