Put in a service request to get a NOID or NOIR from USCIS.

Yeah I think if you get a NOID/NOIR, you can send more evidence of a bonafide marriage.

Outside the questions, how much evidence did you include? You should have another years worth of evidence, as well, since the interview.

Pictures, chat logs, joint accounts, etc.

10/07/12 .. I-130 Returned. Checkmarks did not print. Doh!

Letter recieved today that still has no information or responce when I will recieve a NOID or NOIR from them.... still going no wears

Yeah I think if you get a NOID/NOIR, you can send more evidence of a bonafide marriage.

Pictures, chat logs, joint accounts, etc.

I have a passport with 28 trips to the Dominican Republic stamped with and average of every 45day I go see my husband.

Reports of me being robbed by gun pint in their country.

And letters I’ve sent our congressmen, that I have sent them with his case number requesting they add all that information to his file without receiving a NOID/NOIR form them and I still haven’t gotten any wears.

Sent consent for Senator Marco Rubio office to look into the case

I called USCIS and was referred to speak to a supervisor when spoke to them and asked why I haven’t received a NOID/NOIR letter I was told that they received his case 1/2012 and sent it back to the department of state (I asked why? they said because it had been approved) than the department of state sent it back to USCIS 3/8/2012. For this reason they don’t know why the case was sent back to them and that I needed to talk to the department of state at 202-663-1225 because they were the ones that denied his Visa since USCIS had originally approved his case on 1/2011 and sent it back to them again 1/2012 approved. (Giving me the run around as I’ve never received any letters on this).

Called Senator Marco Rubio to make sure they have received my consent and find out what the next step is. They have my consent and stated the proses could take about 6 to 8 weeks to find out any statues on his case. (Well looks like another 2 months just to find out statues.)

3/1/13 at 11am.

I called the Department of state at 202-663-1225 and spoke to Matt. He then told me what I already know USCIS has to review his case and make the decision if his case is to be denied or re farm to give me the opportunity to appeal there decision. I told him they stated they had sent it back 1/2012 approved but that there office returned it to USCIS. He said sorry but I needed to call USCIS again.

3/1/2013 at 1130am.

Called USCIS to explain what happened the day before and this morning with the department of state and they stated a letter was sent to me on 7/11/2012 ( that I got and it was a response to inquiry I made asking the statues of my case; it only sated that the case was being reviewed that’s all). So know I’m on hold for 30 min waiting to speak to supervisor.

I spoke to Officer Philips @ 1205pm. (the first person in this long drama in the USCIS office to actually give me an answer that sounded sincere)She told me with all the service request I have on my case every time I call USCIS they should know me by name. She told me they do have my case and that it was sent back for review, but since my case was approved by their office already and sent off when it was returned for denial it’s not a priority case to be reviewed by them and has no time limit meaning yes the year and a half I’ve been waiting is common on a denial and it can sit there for another year on a shelf waiting to be reviewed to decide if my case is re-affirmed or denied so I can appeal it.

I than asked her about closing it and starting over and she told me I could do that but, my case might still take longer since they will go back to review and investigate with a fine tooth come why it was initially denied.

I really am at loss on where to go from here now!!!!!!

I wander if it’s me or not, I mean I sent in a consent to Senator Rubio’s last Thursday, and I cc them on my last email to USCIS last week and this is the answer I got this morning.

I wonder do any of our government office check to see what correspond they have on a case before sending out reply’s that only make us feel like no one know what they’re doing?????

It takes a year o a little longer for you to have another interview at the Dominican Republic after a denial. First you have to receive from USCIS a NOIR o a re-approval of your case. According to the time you had the interview you could be receiving it in the next months. So you just have to be a little patient. I have seen other cases like this and all of them take a little longer than a year to resolve. If your appointment was on June 2012, by July 2013 you will be receiving your new interview letter if you case is re-approved.

Mercedes at the Marcos Rubio's office is very helpful, just sent her again your consent so she could go ahead and help you with your case. Fax the consent and call to see if they have received it. While you wait, keep saving every little thing to prove that you have a legit marriage, sent everything you can to USCIS when they sent you NOIR. Then when USCIS re-approved your case, the embassy in Santo Domingo is going to sent you new appointment date. That takes two months after USCIS approve your case. Wait for your NOIR, do not reapply again because as they told you then your process will take longer. Take care!

Day 613 (1year and 8monthes) since denied, just finished faxing and emailing Ombudsman office with the Form DHS-700. That one of our members informed me about last night. I’m feeling this is another positive move in the right direction and hopefully soon I will hear some good news soon!!!! Thank you for all the help and support…….
