I know this is going to end up being a ridiculous question but I have honestly been looking all over for which form we need to fill out and I haven't found a concrete answer yet. So, I am swallowing my pride and asking here. We are doing the K1 fiance visa, just for my fiance. I will be his only sponsor and I meet the guidelines for sponsorship. Do I fill out the I-134 or the I-864? Thanks in advance!

No question is a ridiculous question!

Since you are the sponsor, use the I-134. The purpose of the forms are below.

I-134: To show that visa applicants have sponsorship and will not become public charges while in the United States. The sponsor must file a separate affidavit for each applicant.

I-864: To show that the applying immigrant has enough financial support to live without concern of becoming reliant on U.S. government welfare.

Thanks! I was leaning towards the I-134 but on a link I was sent from a friend who is about a month ahead of us in the process it says to bring form I-864. The link is from USCIS to her and her husband. Is it different for them because they are doing the K3? Our cases are almost 100% the same but they chose to get married right before we left Guatemala. Also, based on your definitions it looks like we could do either...

You are welcome! It is confusing sometimes and the instructions are not always

clearer than mud. Plus, each case is different in one way or another.

If you read the special instructions sections for the forms on the USCIS.gov

website it will tell you a little more. There is a fee for the I-864 but that

depends on where it is reviewed.

You will need the I-134. That is a statement of support for the intending immigrant to show they won't be a burden. That's all that's needed for the K visa.

The I-864 is required for adjustment of status, and is a legally binding contract between the sponsor/joint-sponsor and the US government.

Timeline

You'll need the I-134 for the K-1 visa. The embassy will probably also tell you this as well in their instructions. I know in Colombia it is on the list of documents they require.

134 for the K-1 interview, 864 for their AOS
