Hey guys, I'm seeking all the help i can get. Here goes I currently in the process of filing my I 130,I 765, and I 485 through my Husband(USC) we had file them directly. My WP was approve 2wks ago, and our interveiw is shedule for 03/27/13. 2nights ago my Husband and i got into stupid arguement in which he physically attack me in front of our 2yr daughter. :angry: I called the cops i was taken to the emmergency room with injuries and got arrested and charge with battery and cruelty to child 3rd deg. I intend on filing for divorce. How do i proceed from here on out with my filing since he'll be jail for awhile. Thanks

Look for a lady on here called SanDisk , she will be a big help and can point you in the right direction. VAWA claims take about 19 months and good luck, sorry about all that happened.

snake charme join here in the visa journey the thread "vawa part 3", there are hundreds of vawa filers there. To start your Vawa case get a restraining order against him and take pictures of the injuries; get a copy of the hospital report; copy of police report; police clearance from your home Country;

police clearance from every place you lived in the United States.Get a copy of his birth certificate or passport.It doesn't matter if you submitted to Uscis documents proving bonafide marrige and had the fingerprints done, to file Vawa you have to start all over again and they won't have your file in Vermont. Gather proof of bonafide marriage as well.

You must attend the interview and let them know you will file a Vawa case. Most USCIS local offices will give 30 days to file the Vawa after the Aos interview.

You can keep using your work permit but in order to renew Your WP later on you must have a vawa pending and I-485 pending as well.Most of Uscis offices put a hold in the AOS until vawa final adjudication,and they will ask you to prove I-.360 was filed or that you got prima facie in 30 days, but keep in mind it takes 25 days to get a prima facie then you must run in order for them not to start with removal proceedings against you ok.
