Hi there,

I have a question for you :

My wife (petionner) had no income for 2011, we would like to use only our assets to file the I-864, do we need to include the 2011 tax receipt ?

I'm asking because we didn't fill taxes in the USA for 2011.

Beware of Rant!

I am having a real problem with the attitude of the staff at our Embassy. Whenever I send an email asking for information I get an email reply a few days later with absolutely no useful content. Often they just rephrase the question without making any attempt to disclose procedure or local resources. It's such a bizarre change from two years ago - where they would literally tell you every detail of how to proceed. I am in a strange position. On one hand I want to write back asking why they are so curt, and the other I want to just ignore it until our case is finished. But of course I need the Embassy to get us through the case. In this situation I was able to find out via a Google search that there was a court case against the government to let notaries do translations and that the notaries did win the case. This all happened just recently and there is now a website, but no contact numbers for "Official Notaries". Considering that translation of documents in Nepal is absolutely necessary for the US Embassy one would think the Embassy could direct you with the correct contact information. It is after all their requirement that we have to meet.

Dear Madam/Sir,

Who can officially translate Nepalese documents into English for the US Embassy. In 2011 it was Shree Law Book Management Board in Barbar Mahal. Has this changed?

You are not required to submit more than the latest tax return. You still have to list on I-864 her earnings for the last three years. That would be 2012 (If she earned money last year - April 17 is the deadline this year), 2011 and 2010. What's most important is what she is earning now. Keep in mind that total asset value is reduced to 1/3rd of total value when petitioning for a spouse and they must be "easily convertible" assets. She might consider a joint-sponsor or if someone in her household will file an I-864a…?

I think she should file her 2011 taxes anyway. If she didn't owe anything that's fine, but get them to the IRS to establish a record and send a cover letter stating that although you didn't have to pay taxes because your income was too low - you are filing now in order to establish a "filed tax return record" in connection with a Department of State Form I-864 (affidavit of Support), and immigrant visa. This makes you look organized and it limits the IRSs capability to audit you to the previous three years. If you don't file they can audit every single tax return you ever filed. You want a Tax Transcript. She can order these online and they show up in a week.

Guys i had a few questions, i hope im posting in the right place.So i what ive done so far is paid the AOS fee online. My next step is sending the ds-3032 by email per (http://www.visajourney.com/wiki/index.php/Email_DS-3032_form) Once i do that do i still have to fill out the ds-261? they seem to be covering the same thing... and after that i will send an email and opt in for electronic processing per ( http://www.visajourney.com/wiki/index.php/NVC_Electronic_Processing). It does state not to send before getting the ds-3032 email. I got an email with this form barcoded and also an invoice for AOS, so im assuming its ok to send the opt in email without having "severe delay". Am i going the right way? After this once my invoice shows "paid", I will send the AOS packet in? After that the IV package will invoiced and i can pay it?

Thanks ImmigrationReform, I definitely have shortage of 'Patience' since last few days ;) I've got stuff ready since last week, all I need to do is add appropriate dates to cover letter, sign, write NVC #, and date. Both AOS/IV packages are ready to go and DS3032 email drafted also, just need NVC case # :)

Mannn, I seriously hope you get super-expedited once you've case #. It shouldn't take so long to get files from Delhi to US. Maybe another call to congressman liason?

Something is wrong. Call USCIS and talk with a supervisor. Ask them to give you the day it was shipped and explain that it has not arrived at NVC. You have to speak with someone directly.

Have you talked to Tier 2 at both USCIS and NVC? You should also get your congressman involved. If things are done properly, NVC gets your case pretty quickly, they just take long time to issue NVC #. From your timeline, it looks like they haven't received your case yet.

I remember reading ludakrishna's posts, I think he aggressively perused quite a few options to get things on track. I am sure he'll have lot more to say :)
