Yes - don't do it - the only reason I put supervisor review was that I had a specific situation to remove my lawyer from the case. And that too I sent a separate email for that - the regular DS-3032 did not have supervisor review on it.

She should file married filing separately. Or she can file extension now and file taxes as married filing jointly after you move to US. If she waits till you move to US, she will likely get bigger refund.

I was told by my tax accountant last year and this year that since my spouse does not have an SSN - I cannot file as married but have to file as single. When she comes here then I can send in an amendment if needed.

So for the last 2 years - 2011 and 2012 - I filed as single.

Now reading through all these forums is making me nervous. Should I have had the filing as married filing separately?

How will this impact my case - my I-130 is already approved but am sending the I-864 and Packet IV. I just filed my 2012 return (which I don't plan to send - I only plan to send my three year tax transcript from 2009, 2010 and 2011 (I got married in 2010 and got my marriage certificate in March 2011).

Can someone help me on what I can do to avoid any further issues?

I wouldn't use "supervisor review" for a first email. It's supposed to be used when the first email isn't accepted within the normal 1 - 2 weeks.

I would personally feel uncomfortable "using" the system like that, especially considering the fact that the normal processing time shouldn't slow you down.

I'm curious how other members feel about that?

Totally agree with you. :thumbs:

NVC system is already crowded and there is no need to spam it. The "supervisor title" should be used once your emailed DS-3032

is not processed after 2 weeks. Personally, i waited for 2 weeks before sending a "Supervisor Review".

My spouse (Petitioner-USC) just called me that she is filling her income tax for 2012, is she suppose to put single as her marital status since the information required need my SSN (beneficiary), which i dont have for now. We are legally married since april 2012.

No it should not be single. As you are married.

It should be filed married filling jointly/separately.

I personally, could not obtain certified copy of my spouse documents for ITIN and filed as

Hi floyd,

Seems like every accountant gives away different advises. What I stated in my last comment is what I actually did and everything went fine without issues. This does not necessarily mean you've done is wrong. However, one thing I was told by many was, once married, always file as married (either separate or jointly). I am not sure if filing single will affect anything or not. I do hope others in this thread chime in about what they've done.

One side note, my husband entered US with conditional green card. 2 years later when we filed removal of condition, we used tax return as one of the evidence of 'co-mingling of finances'. So this was another reason why I extended my tax returned and file jointly.

Welcome, our cases reached NVC on same day :)

I think you can send email from your account but I've read that most people send DS3032 email from beneficiary's email account. It maybe worth creating an email account for this purpose.

He has to email it from his own account since it is a document that the Beneficiary fills out and sends, not the Petitioner.

It is about sending the IV packet and AOS packet together in one package.

Is there any disadvantage? and should i include a cover letter?

ps: i understand that IV packet and AOS packet are separate processes that go inside NVC.

DO NOT PUT SINGLE WHEN YOU ARE MARRIED. That would be lying to the IRS, and if caught, you can get into serious issues. Plus, it can also be a HUGE red flag at the interview. If an officer sees you're filing for a spousal visa, yet filed single on your tax returns, what does that say? That this is a sham marriage? Think about it.

You have TWO options:

-Married Filing Separately (MFS)

-Married Filing Jointly (MFJ)

Both have to be done by paper. No electronic submissions are possible.

Filing MFS will probably be the easiest for most people as it doesn't require any extra documents from the foreign spouse. On the tax return, where it asks for the spouse's SSN, you would put 'NRA' for Non-Resident Alien. Continue filling out the rest of the return as normal. That is all you have to do. And if desired, once the spouse has immigrated to the US and has obtained a SSN, the petitioner can then amend their tax return, to possibly get a bigger refund.

Filing MFJ will typically mean a bigger refund up front, with no need to amend. This route takes a little more work though as the beneficiary will have to fill out a W7 (available on the IRS site) and include document(s), so they can obtain a ITIN (it's like a SSN, but for the sole purpose of filing taxes). This would then be included with the tax return, and sent to a special address for ITIN generation. For most countries, it may be hard to get the needed documents. (For Canada, it was uber easy, and this is how my husband did his taxes while I was still in Canada, waiting for my interview).

Technically, the DS-3032 email should be coming from the beneficiary. But, there have been petitioners who sent it from their email. Would it be possible to get the log in details from your spouse, so you can log into his email address and send it from there?

The only "disadvantage" is that instead of sending the AOS package as soon as it was possible, the AOS won't be reviewed as quickly. So, if a checklist was generated for the AOS package, you'll have wasted more time sending in the checklist, if you understand me.

If you send them together, this is my suggestion: put both packages in their own, separate manila envelopes. Write on each manila envelope the name of the package (Affidavit of Support, Immigrant Visa), along with both of your names, and the case number. Then, put both manila envelopes into an actual mailing envelope and send that off to NVC. That way, both packages are clearly labeled, and NVC can send them to the right departments easier.
