Thanks! I'm just confised because the instructions basically say that the only reason you would need to include anyone else in that part (i.e. Fill an I-864a) is if you need to include their income. Hubby's mom makes enough to meet the requirements so I feel like we wouldn't need to. (It also says optional next to the box) I just want to be sure though :S

Also, my hubby and MIL are BOTH filing I-864 forms so that should be them covered. I think we would only need an I-864a if she was including anyone else on the form. Any ideas?

Yeah. Hubby is filing I-864, and he just started new job which SHOULD meet the guidelines but because he just started we're going to use a joint sponsor just to be sure we are covered. (Hence his mom) I'm getting the impression we don't need the I-864a but knowing my luck they'll ask for it. We've been so lucky as well - got case number on Thursday and already had DS-3032 accepted and AOS and IV Fees paid(still pending)!! :D Looking to send the packages as soon as the fees are no longer pending! :)

06/07/08 .. Met while working through Camp America programme in Maryland.

06/02/12 .. Got Married in Inverness, Scotland.

Ugh, just got off the phone with Abigail at NVC. She kept interrupting me as I was asking my question. I KNOW that you tell everyone that NVC has up to 20 days to review my IV file. THAT'S NOT THE QUESTION I'M TRYING TO ASK!!!! The packet only got there on March 1, I'm not expecting that it's been reviewed yet. What I want to know is, IF somebody picks up my IV packet and looks at it, am I going to be penalized, since our IV fee is still showing as "in process", even though we paid it on the 26th and the money came out the next day. Apparently, they'll still review it, as we were able to print out the barcoded sheet. But damnation, somebody needs to get on the ball over there in the financial department. :ranting:

Sometimes I think these NVC agents don't have answer, their knowledge and experience are limited, so they just give what they know as an answer. I was frustrated by them also. :wacko:

Sorry to hear this. You're not alone. USCIS screwed up my file too... make sure you dont give up calling and getting a congressman help you. I finally was able to get my file to NVC. But I still dont know what they will say hoping USCIS did not make any further screw ups.

No. It's never worked like that and it's pretty much guaranteed they'll never change it.

There's probably just a backlog in that department or there's some sort of bug. No need to worry, it'll process soon.

Hey!

So I thought I was clear on this and now MIL is making me have doubts. For the I-864 form...my hubby is obviously filling one, and his mom is being co-sponsor so is also filling one out. Where does the I-864a form come in and when is it appropriate to fill one out? I didn't think we needed one! And that we would just complete two I-864 forms (one for hubby and one for his mom) They live together but have separate incomes. Help!

Husband/petitioner: I-864

MIL: I-864

The only time an I-864A would come into play in YOUR situation is if the husband (if there is any) of the MIL would contribute their income. In that instance alone, he would use an I-864A.

The reason why the MIL wouldn't file an I-864A is because they're technically two different households, despite living under the same roof. If she filed her son (your husband) as a dependent on her tax returns, that's when she would file an I-864A.

Hope that was clear enough!

P.s. How long roughly does it take them to review the AOS and IV packages (assuming there are no checklists)

It's usually always within 1-2 weeks of them getting the package.

Have you looked into asking for an expedite? I read somewhere that one reason to request an expedite is USCIS error. That could make all this waiting around and stressing worth it for you! It's worth looking into, anyway. :thumbs:

I believe I remember reading about that. To my recollection, Saylin did say that once the case number has been assigned, I can then request an expedite. I did submit a service request February 22nd with the USCIS and will wait to hear on March 8 (which is what they said when I called today and also on the 22nd). Although the file has been shipped from New Delhi to NVC, I don't know how long or where its currently at. Just frustrating and sad. Will call the Senator's office tomorrow. Once its at NVC, I can then breathe.

Yes, with your case, there were a lot of errors. Once the case number is assigned, definitely request for an expedite, as you've lost a lot of time. I've seen them approve expedite requests on USCIS error before in the past, and it was even less severe than your case. Although, since it's dependent on the embassy/consulate, the outcome might differ. Definitely worth a shot though!
