On the phone they just said that I need to send an email to NVCINQUIRY@state.gov noting that I need to remove the lawyer from the case. I can update the DS-3032 to add a line to say that "We are no longer going to be going through the lawyer that filed the I-130" or something like that.

I don't understand what will work in my favor - I am just afraid that something goes to the lawyer and since I am not using him (and I had a very bad experience with him) that something goes to him and he does not communicate it to me.

So what's the safest way of doing this - send an email separately from me noting that I no longer wish to use the lawyer AND add a statement to the DS-3032 that we no longer wish to use the lawyer.

Is there something else I can do that can make sure that my lawyer is totally out of the picture and there is no complication later on?

Thank you so much Saylin - god bless you for helping all of us so much!!!!!

Alright, if the email is needed, then send it asap. Then include that line on the DS-3032. Send both NOW.

Remember, as long as NVC has both email addresses, then all correspondence is sent to everyone. They're not going to send something ONLY to the lawyer.

You might want to consider putting the magic part of "Supervisor Review" at the very beginning of the subject line for the email about removing the lawyer. That way, the email will be seen tomorrow and thus removed tomorrow.

You can only check through calling them. The number is on the first post, along with NVC's.

Guys, reading the shortcut pages, and the i-864 website. I think i'd be eligible for an I-864EZ, it's for my spouse, and my income alone is being counted. Does the NVC accept I-864EZ or should I wait until I get the letter to fill in the correct document?

From the state.gov website: http://travel.state.gov/visa/immigrants/info/info_3197.html

IF All three of the following are true:

You filed a Form I-130 petition, for your relative

There is only one applicant on the Form I-130 petition, and

All your qualifying income comes from a salary or pension and shows on one or more W-2 Forms that you receive

THEN

Complete an I-864EZ. on your computer using CAPITAL letters

Review the I-864EZ Checklist

Print the completed form

Attach the bar code sheet, and

Mail them to the NVC unless you have joined the E-Mail Electronic Processing program, then…

Scan the I-864EZ to Portable Document Format (PDF) and send it as an e-mail attachment to NVCElectronic@state.gov. Sending physical documents to the NVC will delay the processing of your case. When sending completed forms to the NVC do not include instruction pages or any other sheets which do not carry information you entered while completing the form.

On a totally different note, I just realized that I didn't complete the form in capital letters. ARGH another thing to worry about!!

Thank you again Saylin

Just download the form from USCIS's site (under the Forms tab). I used the I-864EZ ;)

Definitely don't worry about not using caps no0pb.gif We never used caps for any of the forms and had zero problems.

Keep in mind, NVC receives probably thousands of emails per day. It does take them awhile to get through everything.

Are you referring to the DS-3032 email or something else you sent them?

Yeah I figured it was a result of email volume. The email had to do with the confirmation that they have received my file.

I called today however and they finally confirmed that my case file was indeed received at the NVC on 2/25/2013.

So now we wait for our case number to be generated.

I am the petitioner.
