You need to be legally resident- each embassy has a slightly different take non this, check out our DCF forum and look for China filers there to learn more: http://www.visajourney.com/forums/forum/82-direct-consular-filing-dcf-general-discussion/

The K3 is obsolete for two reasons, three in your specific case:

- In almost all cases, it gets closed at NVC stage and you are forced on the CR-1 route.

- K3 was designed to be faster in years past, when the CR-1 took 3+ years to get. They are now the same speed and the K3 is not as good, as the visa holder doesn't get a greencard upon entry to the USA, thus cannot work or travel as freely as a CR-1 holder who gets a greencard immediately.

- In your specific case, K3 is not available via DCF, only CR-1 is available this way.

A K2 is a fiance visa, if you chose that, you must wait till you two get to the USA to get married, and then must marry within 90 days. Drawbacks are that it is slightly more expensive than a CR-1 and cannot work or travel for 3+ months after marriage (sucks if there is a family emergency back in China). K1 is certainly an option, but a poor one, especially if there is a chance of her getting work in the USA immediately.
