Petition is back at USCIS

My petition was sent back from New Delhi May 3, arrived July 11 and was first "touched" November 2. My six months have passed and I called to request a review and a NOID. I asked the operator when I could expect to hear something and she told me she would put in my request and told me not to call again for 45 days! :clock:

The consulate emailed me and they gave me the dipolmatic pouch number. I called all over america, it is just a big waste of money maybe them sending it back will be good, but I think it will just hurt us more. They say we had not been together long enough you know. So tell me how do you defend this.

My petition was returned in May 2006, received in July, I had to wait until the 180 processing time passed until I could ask about it and after I did I received this in the mail.

"Monday, December 11, 2006

Dear XXXX,

On 11/09/2006 you, or the designated representative shown below, contacted us about your case. Some of the key nformation given to us at that time was the following:

Thank you for your inquiry regarding the listed petition. Said petition was returned to the California Service Center (CSC) by the State Department's [consulate/NVC] for review and was received in the CSC on or about 7/11/06. All returned petitions are reviewed in the order in which they are received, and due to the high volume of petitions returned to our center daily and the various complexities involved in returned petitions, we may make no predictions as to the amount of time necessary to complete our review nor may we release for return to our center until the review is completed.

If you have any further questions, please call the national Customer Service Center at 1-800-375-5283."

I thought I would post since I am a little ahead of y'all. Sorry, not to offer a light at the further end of the tunnel. It is really heartbreaking.

My petition was returned because the it expired at the Embassy and the CO decided not to extend it and it was returned. Since my case wasn't sent back as a review my lawyer said an expiration could be refiled so I did that and am waiting to see what will happen.

I was looking at my husbands approval letter last night and it has an expiration date of 1-23-2007. This is the returned petition of course? What do they do after it expires? Anyone know??? Do they extend it?

I will call them for sure, I was just wondering if anyone had any exp with that?

From what I have seen, the K-1's sent to the CSC usually expire, and you have to refile. They take the K-3 and CR1's more seriously. Unfortunately you have to wait out the process though.

To the OP, I hope you don't get married until they expire it, if they do. This just creates a bigger mess.

For all of those in this situation, do not despair. My husbands 1st interview was on 8/22/05. After 16 months of hell he is finally home with me. The key is to spend the time wisely. Go for many visits, get letters of support from friends and family, and try to determine why they think the marriage is fraud. Sticking it out and proving them that your marriage is real is vital. I am so sorry for all of you just starting this process.

No, I haven't heard anything from your friend yet.

I did call USCIS and the op said it wont be a problem if the investigation goes on pass that date, when it is all actually a very big problem. To me anyway.

I got an email today from another immigration specialist from anothre congressperson. I called as soon as I got the email and left a message for her. They closed early and wont be open until wednesday. Theyre gonna be closed on Tuesday in honor of the President G. Ford. So be it, wednesday it is.

Going as often is a good thing too of course. I'm hopping on the first plane and opportunity that comes my way. April is a definite opportunity cuz babygirl will be on spring break. I am trying to get my sister to stay with my daughter for the week after spring break so I can stay for 2 weeks and then most likely I will be in Morocco all summer. So we shall see....

Fraud.... insulting! Very.............

Hey......

My husband had his interview today and he was issued a 221(g), it said they were sending the petition back to the States. I called the congressmens office today and I had my husband fax over the form he got, and them I faxed it to their office along with a hand written note and the approval notice. I am about to email the consulate in casablanca and see what type of reply I can get. I dont know if I can make it a whole year..... I have to know what to do next.... even if it means relocate.......

Will emailing them do any good?

Its sounds the same as mine experience. i see you are dealing with morocco also...my fiance got a 221g way back in sept 2005 and they (morocco) sent our papers back to vermont. and in april(2006) i got a letter fron uscis and told me that in 60 days i should get a desicion.. today dec 29,2006 im still waiting for there desicion..i write to casa all the time but they cant give me any status on our case ..they just keep telling to contact vermont..but i have done everything i know to get them to respond...they just dont....i now got a congressman to help me get some more answers..i sent them all my copies of everything they needed...to help them to see if they can get vermont to respond to them.....do you know if the congressman can get answers for us..i have been waiting over a year now..i know how you are feeling about the waiting...its very hard for us also...i have thought about moving to morocco to be with him ..but i found out it would be hard to live there.... to me i wouldnt be able to communicate well.or able to get a job....jobs are very difficult to get there..... i cant say what to do next...because your in the same as me...i just wanted to let you know that your not alone in this...i have same questions same as you...who do we ask for answers.....they tell me to call uscis....i call the number and the operators dont even know the answers....

WOW, they returned your case are you in the Desert Rose Group?? You where temporary denied and tehy do not believe you have a valid relationship. Please PM me. Let me know if you in the DR2 Group and did you get anything asking for information. My fiance and I are just going to forget it and do what we want. The process right now is crazy, they take a long time and on top of this they seem to not care. They gave you the Dipolmatic Pouch number so you can call this guy and he can tell you where your case is? Please look for support and email me. If you need. If you are okay then ok.

hello there not to my knowledge we were not denied we did get a 221g letter yes i did have to send in more information on our on going relationship.that was sent in along time ago after the interview in sept 2005 they recieved it and sent me a letter in april2006 (Which was along to for them to respond to me) telling me they would send me a desicion in 60days ...60 days has come and many times now..i have been on the phone to them many times and they keep giving me more days to wait....far as i know my case is in vermont still they just wont respond and then they sent me a letter the other day and tell me i have to wait up to 6 more months for a desicion....what is this dipolmatic pounch number you didnt explain tome what it is.....i dont know what this Desert Rose Group is either please explain all if you can ...thank you Ella :help::help::help::help:

Well you should be in the group by now I post on the board and I informed the ladies to get on here and help you guys out and they have invited a few people. however, the pouch is how they return the case. It is a secured document and it is like a tracking system. it goes back to the NVC they record the information for fuard purposes and then it goes to the service center. I recevied a letter from the service center telling me that they have my information and it is being reviewed. If you sent it the information. I hope that you sent in a lot of good stuff and wrote a very detailed letter. You seem to be on the decision part of the process so good luck to you. I hope that you get approved, but I hoep that you address all the reasons that you think you where denied for. Keep us posted. The DR2 is a groupd of women that where denied by the moroccan consulate, we share infomration about our research and what have found and we give each other support. This place is not hte place for it and when I was denied I had to go through this bs of people telling me this and that. They would read you profile and they acted like I was stupid and I sent in the profile to immgration. Nobody has everything and some people do not understand. I hate immgration and if I could do this all over again I would not. The board seems to have some people that believe because they were lucking and they got through it they know everything. So sometimes when you come to VJ for help you receive everything but that, so a lady named Kiyah formed a group and it is a wonderful group. We all get there and vent and share. I love it a small comfort in this cruel process.
