I'm in a bit of an awkward situation. My fiancee, is Colombian. We're getting ready to fill out the forms for her k1 visa, and I asked her for the information about her parents. It turns out her parents aren't her legal parents.

She was born to one couple, and at 8 months her biological parents gave her to another couple. They did not formalize this relationship legally. So there are no adoption papers, no records at all of her family situation. I'm not sure what to do about this or how to fill out the g-325a. Here are my basic thoughts:

1) Put her biological parents on the form. She can get a birth certificate and it will have there names on it. However, she knows literally nothing about her parents and I'm not sure if that will meet the spirit of the law. And I'm not sure we have the birth dates for her biological parents. In addition if later we want to bring over a "family" member then here's no real record of this family and I just see this as getting very complicated.

2) Try and get her to do something in Colombia to formalize her relationship with her "familial" parents. I'm not sure what this process would be. Add to this the man she thinks of as her father passed away 3 years ago. I have no idea what that is going to do to the process.

3) Put the information about her familial parents on the form, and let it go at that. The only problem with this is if they ask for her birth certificate the parents on that form won't match the parents on the form on file with the US Government.

Has anyone been though anything similar? Anyone have any information they might be able to offer about how to clear up this problem. I'm certainly at a loss for how to proceed.

Read carefully, interpret literally. The G-325a asks for parents information "if known". Simply enter "unknown" for anything not known. Done.

HER birth certificate should list the names, at least, and possibly their dates of birth. Whatever you can get from that, fine. The rest leave as "unknown"

I would not enter her adoptive parent information as she will have to submit her birth certificate and obviously that is not the same information.

Not a material issue at all.

Any "adoption" of her as an adult will do nothing for immigration. The woman that raised her will never gain immigration benefits through her. If she doesn't know anything about her bio parents Unknown is the correct entry.
