NEEd Advice... ok so I called the uscis today, to check on the status of getting my file back to review. Now for some reason I got a young talkative man this time . and this is what he said..Why didn;t you file a k-3 so he can be here with you?? I said I thought those were absolete.. He said nooo.. So he told me to take my NO1 notice of th I-30, mail it to the national benefit center with a I-29F (no fee) and they will send it over to NVC for them to set up an interview for the K_3 so he can be here while we wait. and if for wat ever Crazy reason he might be denied again at the K-3 interview, It won't affect the I-30 and he will just have to wait for the I-30,,,, I trying to make heads or tails of this..

Hey Chi, this got me so curious so i went to the USCIS site and it looks like k3's are not obsolete.

"Immigration law allows the alien spouse of a U.S. citizen and his or her minor children to be admitted to the United States as nonimmigrants while they are awaiting the adjudication of a Form I-130 Petition for Alien Relative. It also allows them to obtain employment authorization while they are waiting.

Eligibility

To be eligible for a K-3 nonimmigrant visa, an individual must:

Be married to a U.S. citizen

Have a pending Form I-130, Petition for Alien Relative, filed by the U.S. citizen spouse on his or her behalf"

I say since there is no fee to file do it ! that would be wonderful if he could be here during the waiting process. :dance:

That is a load of ####### and USCIS doesn't have a clue. More than likely I-130 will get to NVC first and they will close the I-129F. The poor misinformed operator thinks you can have two petitions going. So if one gets denied Oh wait the other you can ask to fire up no. It will be closed 99.9%.

The reason we say obsolete is because its rarely ever enforced and doesn't do what it use to which was get married couples here faster. You are at NBC you probably will be approved faster than if you went to CSC or VSC. You could file I-129F with all the documentation and such and see. It can also I have seen slow down your Itogether-130 because they want to keep together .

K3 is on the books but its very dead. And you know the government slow to close or delete things.

i stand corrected dwheels and i am glad you are around with sound advice. :thumbs:

No wahala we are all here to learn. And I so wish USCIS would delete that Visa it causes dashed hopes. Even in the rare times it gets to embassy it us lost they\reually just buys the couple a few weeks.

I know one couple they did the K3 route had the I-129F cancelled after they were already done at NVC case complete. Case got sent back to USCIS they lost 3 months and USCIS kept or lost all their NVC paperwork (affidavit or support) and DS-230 package. They had to redo. :angry:

I know OP if you search on K3 you will find two resent (within the last month) people who made it to Embassy. One I stated they cancelled hers because of the I-130 (The I-129F got there first) and another they had to make the choice think they picked K3 (why they didn't want to wait the 3 to 4 weeks at NVC I guess).:wacko:

Actually if processed correctly you could have 2 petitions opened. Back in the day a CR1 took years , so the K3 was relief to the wait for USC's. The gap isn't really there anymore but the petition still exists on the books. We had a friend and daughter arrive on a K3/4 2 years ago. You have to file the I129F while the I130 is still at USCIS and the I129 has to beat the I130 to the case assignment desk. If they do it correctly the I130 is placed in suspense ( not cancelled remember the original intent was to be together while the I130 is adjudacated ) The I129f goes to the consulate and you get an interview. Everyone knows that Lagos likes to deny , but you either get the K3( and K4's igf included ) or they deny it. In a properly processed group you could actually contact NVC and get the I130 pushed up to the embassy. The problem was is that they were both put together at the same time with the same evidence so there wasn't much hope for it either.

This will not be over quickly. You will not enjoy this.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Thank you for the replies, infos, and some frustrating story...would really help me to decide which one to apply..God bless you guys and hoping more infos to get..another question is, am I the one who will apply or bring the requirements here in the Philippines or is my husband who will apply it in US?
