Hi Everyone.

We are helping my fiance complete her Adjustment of Status (AOS) after coming here to US on K1 visa.

We didn't have time to complete everything for AOS prior to marriage, so we are hurrying to do it now (only married one week ago).

Question: My wife intends to change her last name to match mine. However, by accident or by not paying attention, our marriage certificate shows my wife's maiden name, and not her new last name. When filling out the AOS paperwork, should we use her new name, or her maiden name.

Some states/counties will only put the maiden name on it anyways. Mine has maiden name because they use that procedure here. All AOS documents are submitted in married name when that's the name she'll be using.

Bring a copy of marriage certificate to the biometrics appointment - some people have been asked to ID themselves with passport/ID and marriage certificate.

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

It depends on your state.

1. My state (among others) lists both maiden and married name on our certificate. If I had maiden in both spots I couldn't change my name to married name without a court order;

2. some states list maiden name only but you can still change your name to any variation of your last name and his last name, or just his last name or just your maiden name; and

3. some states list married name only and require you to sign in married name (this is the rarer option but I forget which state).

Most states are either option 1 or 2. Most likely you are option 2 and should have no problem just putting your married name on the forms and maiden in "other names used". if there's a problem USCIS will tell you.

Yep, check with your state on the procedures. In my state, it only lists maiden name. If you want to change to married name, you go to SSA, DMV, etc. and just get it changed on your paperwork. But in other states, that isn't the case. I can't tell from your profile where you're from so we can't give you more detailed advice.

11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot
01.24.2011 - Approved! Card production ordered!

REMOVAL OF CONDITIONS

11.02.2012 - Mailed I-751 packet to VSC
11.08.2012 - Checks cashed
11.10.2012 - NOA1 received, dated 11.06.2012
11.17.2012 - Biometrics letter received for 12.05.2012
11.23.2012 - Successful early biometrics walk-in

Yep, check with your state on the procedures. In my state, it only lists maiden name. If you want to change to married name, you go to SSA, DMV, etc. and just get it changed on your paperwork. But in other states, that isn't the case. I can't tell from your profile where you're from so we can't give you more detailed advice.
