When we return the requested data do we leave the 797c, notice of action attached to the packet or remove it?

Are you talking about the RFE notice? The RFE notice should be on top of whatever additional evidence you are supplying. And, of course, make sure you make copies of whatever you're sending out.

Sorry, I just noticed this was for AOS. It can't hurt to send a copy of your AOS NOA1. The more important thing to put on top of your evidence is the RFE notice, though.

I have another question, before filing for AOS we did copies of everything before we sent it to them, right? I'm just confuse if DO we need to make a copy of the RFE Notice that we received and arrange it according on how they arrange the documents?

I would make a copy for yourself of the RFE and any new evidence you submit. We had an RFE on our initial K-1 petition, so basically when we responded, the RFE notice went on top, then the evidence requested underneath. I guess it depends on how much evidence you need to submit. I would arrange it in the order of things requested, then copy the everything that you're sending back to them. The most important thing is to have the RFE notice on top, as that will have the case number on it so your new evidence can be tracked back to your original packet.
