Hello Everyone,

I was wondering whether it is possible for the spouse of a US citizen to enter the US with a VWP/Visitor's Visa and to file for AOS after a while with the intention of staying in the US with the beloved one. I know you are not supposed to enter the country with through the VWP when you want to stay in the US, but is it possible to file for AOS successfully ? On what would the success of such an enterprise depend ?

If someone does this, then it is called " AOS Abuse ". It all could go wrong ( depend up to each applicant ).

It is called immigration fraud, not just "not supposed to". If you are found guilty of it, the results are denial, deportation and a lifetime ban.

People who have successfully AOS'd have usually done so without intent and "change of circumstances". As you are planning, you are planning immigration fraud.

It is also again the VJ TOS to give advice about immigration fraud.

Do I understand that you are already married, and your spouse is outside the US?? If that is true, then using VWP to "visit" and then stay sure sounds like intent to immigrate to me, so put yourself in the role of an immigration officer that you are trying to convince--what possible arguments can you come up with that are even slightly convincing, and you can see the problem.

Why not just start the CR-1 process, and your spouse can almost certainly visit while it is in process ??
