Forgot to Report Change of Address

Hello everyone,

I have not posted here for awhile, but I have a question. Here is the situation. My wife received her conditional green card in June of 2011 while we were living in Utah. In July we moved to Arizona for my first year of Law School. However, we did not report our change of address. After a year in Arizona, I transferred to a Law School in Colorado, and we have been at this address since we moved here last year. We also did not report our change of address.

We simply forgot that we had that obligation. I just looked at the change of address form, and it asks me what our last address was. Should I put our address in Arizona? Or should I put our address in Utah, because that is where we were when my wife received her conditional green card?

It doesn't have a space to put more than one former address. My sister and her husband have been living at the house we were at in Utah since then, and they received a letter for my wife there, and that is when I started thinking about reporting the change in address.

Alternatively, should I just report the change of address when we file for removal of conditions, because on that form, it has a space to put any addresses where we have lived since receiving the conditional green card? We are planning on filing that in about two weeks anyway.

I know I shouldn't have forgot to report the changes, but we did, so now if anyone has any advice, I would appreciate it. Thanks!

Not reporting a change of address in a timely manner is, technically, a breach of federal law.

You should file the AR-11 now and hope that they don't care enough to ask you about the date mismatch.

Your immigrant wife needs to file AR-11 now with correct details - meaning give the correct last address (don't manipulate, as it could bite you guys hard, if found). The worst could be that you may be asked to explain why you failed to report the previous changes and you can always explain the facts, if you receive such a letter/ inquiry. Also if you filed I-864, then you will need to file I-865 (change of address) - the US citizen that files I-864 has the obligation to notify the change in address.

My husband gained permanent residency in December 2010 after our June 2010 marriage. We purchased our first home in August 2011. When we began to compile our documentation to remove his conditions, we realized that we were supposed to change our address when we bought our house in August 2011!! :blush: I was really concerned that this would be an issue for us, however, we immediately filled out the proper paperwork and submitted them ASAP. Thankfully, the change of address was acknowledged with no letter from Immigration on either parts giving us a hard time! Whew!

My advice is to send the change of address ASAP. That is what we did and then we filed our joint I-751 package with our current home address!

I speculate they realize that these documents are not well published as far as persons being aware as to what to do during an interim address change. Again, I guess, that the AR-11 is mostly what you see when you search the WEB. For some reason the I-865 hides better than the AR-11.

I don't think anyone got one - and I think it could be due to the following - my 2 cents worth reasoning:

1. USCIS in many cases couldn't update the addresses filed in time due to staff constraints and unless they are upto date, they can force it.

2. The main purpose of such reporting is to have the right address for contact when needed and I-751 will provide that during the conditional GC period (may be they will view the post conditional GC period more seriously).

3. USCIS doesn't have enough time for the more pressing work and may not be wanting to make this an big issue.

Since I came to US I moved 2 times and didn't file any forms to change my address, even though I filed I-751 on january 14 and used the address that I live in now and I recieved the extended letter and the biometric letter and did my biometric as well , I remember in the I-751 there's a question asking about if I moved since I came to US and I marked yes and added my old contract and the current contract. Should I do anything about that DO I HAVE TO CALL USCIS or something

I understand that your I-751 did get the latest address changed, probably that might have just changed the Immigrant spouse address only. Though I-751 is a joint filing, the US spouse address may still be the old one.

I suggest that the US spouse (if filed I-864) to file I-865 and it doesn't hurt to file AR-11 also for the Immigrant spouse, to be on the safer side. That way, both of you comply with the address change requirement.
