My case is I-485 based on marriage and my husband is a usc.

We had our AOS interview last year at Oct.

It took about 30-40 minutes.

The only problem I felt was that I was in another state at that time, cuz I haven't graduated from my school. We explained this to her, and she seemed fine with our explanation.

She didn't even ask for all of our proofs.

She didn't ask anything about the detail of our marriage.

Basically, I felt the interview was fine, and at the end of the interview she said it was fine too. So I was really surprised that I didn't get an answer on the spot:(

She took my I-94 but didn't ask for my EAD. At the end, she let me sign a piece of paper claiming that I had no criminal record. Then she let us go.

I made an inquiry by phone a month after the interview, and got a letter saying my case is under review, and it may take up to 90 days to make a decision.

Now totally four months passed, still nothing heard from USCIS....

Really frustrated, and have no idea what takes them that long to process a case.

Anybody who knows whats going on?

YOU call into USCIS hotline, get an ISO, and ask for casefile status.

Also ask if any returned postal mail pieces on you.

Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

YOU call into USCIS hotline, get an ISO, and ask for casefile status.

Also ask if any returned postal mail pieces on you.

I actually called them many times, and made inquiries for twice. But none of them work.

My case is now still under review.. No news since the interview :(

I don't know what to do to make my case move forward

I think we will do it on March, and hopefully there will be some progress.

Is four months long enough for the waiting?

I know most people are approved on the spot, but I also know that there are some other people waiting for years.

This scares me somehow and really don't know what should I expect.

Will I wait for a few more days or the four months after the interview is just a beginning?

Kinda feeling lost, and the waiting is like forever.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Its unlikely that you are waiting for the Officer who interviewed you to make a decision all this time, or their supervisor. Since you signed something saying you had no criminal record (which is not typical) it seems like you might have had your biometrics done right before the interview and they didnt come back clear yet, or you did them a while before and the Officer saw that your fingerprints hadnt come back clear yet- hence he or she made you sign something saying you have a clean record.

(Because everything else looked good to approve you, thats why they took your i94, all that remains for approval is the fingerprints being clean)

Fingerprints done through bimoetrics usually come back clean in 2 weeks. In rare cases they take longer. Sometimes theres a hit. (Around 20% of the time) It takes around 6 months to resolve it. In less then 1% of the time it takes more then 6 months to resolve it.

You should return to the local office and confirm that they are waiting for your fingerprints to come back and that there is nothing else holding up your GC.

If it is fingerprints you are waiting for there is nothing you can do to make it go faster.

I thought about maybe the delay was caused by the FP as what you said. Because, personally, I don't really have clear finger print. So after nearly one month of my first finger print taken, I was called back to do it for the second time. I did not think that my FP would ever pass, but the fact was, one week after I done my FP for the second time, I got my EAD. I was surprised at how quick it was.

Then at the interview, the lady who interviewed us asked me like twice about my FP. When the last time I took it etc. I was quite confused about why she took a focus on my FP. Also like what you said about the strange piece of paper claiming no criminal record.

Is there anybody else was asked to sign that kind of stuff? Anybody knows what is it?

But other than this, the fact that I have already got my EAD and also the response letter toward my inquiry saying my case is under review let me doubt that if my case is delay due to the FP or not. The delay due to the FP should claim like "background check," isn't it? I am not so sure.

Anyway, thanks a lot for your help. We will book an info pass to see what is holding my case back, and we will hire a lawyer if we still have nothing heard from them.

Hopefully, anyone whos in the similar situation as we are can hear from USCIS very quick.

Well, I just got some update toward my case, and hopefully this can give other people who are in the same situation as I am a little help.

Today, we got the letter we were waiting for two weeks, since we made an inquiry through the 800 number.

It says they determined they need some more information from me to process the case, and they asked me to make an infopass to visit their local office.

My husband insisted that it was a second interview notice, and felt really bad about this.

However, I don't really think so. At least, from what we got now, it is just an info pass, although we have no idea what the info pass is going to be about, or what they need exactly from me.

Now, the info pass website shows no appointment time available now, so we still need to wait to see what is gonna happen.

I'd like to hear from anybody who can provide us any suggestion.

Do you think it is a second interview notice? Is it possible for them to let me make one during the info pass? (I heard a lot about the second interview, and it seems really scary, like the videotape...)

What do you think they need from me? Since there is nothing said in the letter telling me what I should take to their office.

Do we need to hire a lawyer? (We are not really wealthy, but it won't let us broke to hire a lawyer either...)

Do both of us need to be there on the info pass? (My husband is always really busy:( )

Really appreciated for any help or suggest provided by your guys~:)

This is ridiculous! Not only that you have waited 4 months for decision, but now they ask you to make an appointment yourself and there are no available dates! What if there are not available dates in the next couple monts?

if I was you, I would take this letter and try a Walk In early in the morning. Explain your situation and they may give you at least an appointment date and hour. Good luck :thumbs:
