i am disabled from military service with a TBI, if you dont know what that is please allow me the courtacy to explain... i am wondering if that would quailify for the extreme hardship, would it?

THIS IS FIRST TIME I MENTIONED NOT MEETING IN PERSON... hint is the extreme hardship..................

When asking for advice or "do I qualify for this" its better to not give hints and rather just come right out and say this is the situation - do I qualify?

So to sum up- You have a brain injury, you have not met your fiance in person because ... (fill in the blank)

Im going to assume your claim is your medical condition prevents you from traveling. So whats her excuse?

Can she not get a visa? Do you have proof shes denied a visa?

Do you have proof you are restricted from traveling? Not by air, not by land, not by any means that would get you to her?

If so- then yes- that is an extreme hardship and you would qualify.

No the "hint" is not extreme hardship because that is what people need to show for hardship waivers for overstay, deportation and other things like that. It's also what people use to get their case expedited. Better you actually state the issue, which you have now done.

It is SO much more than that. It is extremely hard to get the "not meeting in person" waiver, as in basically impossible. He needs to demonstrate attempts to meet, including to other countries (if she can't get a visa to the US and shows multiple attempts to get one), his inability (and proof of attempts to travel) to travel to any location that she could meet him at and so many other things. I don't think i remember seeing any approved.

I've read stories about wheelchair bound people and it's still not good enough.

My medical records are missing and thus was denied from having anything from the VA... getting a letter off to the IGN ASAP

if your medical records are missing how can you prove the extreme hardship?

Your girl is from Greece - she can apply for the ESTA (visa waiver) program. If that doesn't work, she can apply for a tourist visa, although she will have to prove strong enough ties to her home for that to be granted or for her to be let in at POE. As others have said there are "extreme hardship" waivers for many things in the immigration realm. It's not just for waiving the 2 year meeting requirement for the I-129F petition. If you really truly can't meet her here or there in Greece you will need to get all your paperwork (ie medical records) in order. Your physician (or better yet specialist) would also need to write a letter attesting to the fact that you cannot travel due to your condition. USCIS will not simply take your word for it that you're disabled. Even if you've shown neither of you are able to see one another, that's no guarantee they will waive the requirement in your petition. You can only make your case. I hope for the best for you, though.

There is no penalty for trying to put the expedite in. There are a few past cases of expedites that "seemed" to have a weaker argument that were approved. Won't know till you send in the request :)

Please note the OP is not talking about expedites. 13 posts in he finally clarified he and his fiancee have not met in person and he wants to request the waiver for not meeting in person.

OP, no need to be rude. Most people here talk about hardship in terms of expedites and that's why everyone assumed so.

You will not be waived for not meeting in person. Basically you would have to be bedridden without any possibility of ever getting up and she can't (but has tried to) visit you either.

That is very true.

Yes, very true for EXPEDITES, but that is NOT what he is asking about. He has now clarified he is asking about proof of the "meeting" requirements. Which is rarely approved. I would say 0.1% of applicants are approved, if that.
