Hey folks I need some help and I am sure here I can have some helpful people give me some good advice. My fiance has been her in the US for a little over two months we tried to get his social security card but were made to wait 5 weeks for a response finally we got it. We went to the DMv to get an Id and they refused stating his I-94 expires in 6 weeks. I have no money for the next adjustment of status and I dont want him to be here improperly nor do I want him to leave. We will get married next week as all appointments were full until then and he will have his i-94 expire about 6 days later are we ok? Will he be in violation it is within the 90 days but cutting it close and it will be a few months before I can afford to do the next formal step. Any help is greatly appreciated, thanks in advance to all.

I hate to say it but you should have considered that you wouldn't be able to afford the AOS/EAD filing fee before you even started the petition. In the grand scheme of things it's not a lot of money, especially considering there will be other fees in the future for removal of conditions and the citizenship application. You also need to be supporting him while he waits for his EAD and then begins searching for a job. As long as you are married within the 90 days he will be able to apply for adjustment of status from this K-1 visa.

I caution you though - you are really screwing him over by not helping him file for AOS (financially). He won't be able to work or leave the country while he's out of status. Do what you have to do to save up for it ASAP.
