Hello:)

I just had a couple questions...

I entered US with a visitor visa, after getting married my husband (USC) called immigration and was told to file the form i130 (petition for alien relative) together with the biographic forms. It was now approved and we were told to file the i485 form...but my questions are:

1- do i need to send again a copy of the wedding certificate??

2- i mailed my i94 with the i130, is that a problem?

3- do we need new passport style pictures?

I was told to also send in form 1864 (husband is the only sponsor..) can i use the EZ version? And i was told by an immigration laywer to make my own appointment for the medical (i693) is that right? And also, what to do if i donnot have my vaccination records?

And before i forget, can i also apply for my work permit now (i765)?

I am sorry for so many questions, but hope you guys can help me :)

Yes, you need to send a copy of the marriage certificate.

Yes, to passport pictures. We got ours at Walgreens for $8.00/page.

If you have a copy of the I-94, you should sent it too.

(If you don't call them or send in a letter explaining why you don't have it with your application).

Complete the application totally. Even if it's duplicating things they already have.

you need to include an I-864 with the AOS. Don't use the other version.

You can get the list of civil surgeons for your area and book a medical with them (that's the I-693).

I called my doctor in Canada and they faxed my vaccination record to the immigration doctor. I imagine if yours exists in your other country, that you can request it. if you don't have it, you will need to be revaccinated.

You can apply for your I-765 at the same time that you file to adjust status.

Lol, I just went through the whole process this weekend, so I know these things.

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

Yes you can use I-864EZ if income is more than enough to meet the 125% poverty line requirement.

You will need to have a civil surgeon to have the I-693 medical done. List of Civil Surgeons

You can go to this link and at the bottom of the page, select your state/area and you can get a list of civil surgeons who can do your medical exam. i called about 5 different ones and the price varied from $125.00 - 285.00, so it pays to shop around.

Sorry, not sure if you can use the EZ AoS, I just used the one that was sent with my I-485, form.

why did you not file everything together.... I-130.. AOS...EAD.. you dont have to wait for the I-130 to be approved.... you could have had your interview for AOS by now and have your greencard in hand... oh well I hope you have a speedy remainder of your journey....

Because immigration directly told us to do the I130 first...

Do i need to file a request for a duplicated I94?? I forgot to mention that i had previously requested an extension of my stay so i did not overstay without authorization...i have the approval letter but am only missing the actual replacement I94.

Hi- About the I94, I think you only needed to send a copy of it with the applications...As far as I know, they usually take the original from you when you go in for your interview. I would say send your AOS packet with a copy of it, but you might want to start the process of getting a replacement one in case you need it for the interview.

the I-94 should be inside your passport... if you no longer have it you will need to file for a duplicate... so you can submit a copy with your AOS.... you will need the original at the interview...

Dont send any originals with the AOS only copies

They gave you bad advice.

They sure did..... nothing changes....

Also another piece of advice, never send original evidence items, send copies, the only things that need to be origionals are the signed forms like I-130, I-485, G-325A forms. You take the origional evidence items to the interview, and the officer can verify them then.

The cost to replace the I-94 is $160 and file form I-102, I-102

I am gonna file the form 102 this week, but what is the problem if you donnot have you i94 for the interview?

Also, i have the approval letter for form I130, so i can just send it with all the other forms now, right?

Do not send the original approval letter send a photocopy only.... you need the I-94 at interview because it proves you entered the country legally.... the office dealing with your AOS will not be the same office that dealt with your I-130... as you did not file together... so they will not have the original available to them at interview time...

I learned that the hard way...stupid stupid me:(

They told me i can file form G-884, Request for the return of origial documents, i was told i can probably explain in my I485 form why the copy is not included (i was so stupid that didn't even make a copy of the I94, all i have is the letter of approval for my extension...)

What do you guys think i should do?
