Hi guys,

me and my wife(USC) got married couple of months ago and have decided to get started on the AOS process. I have been able to fill out most of the paperwork so far with the help of these forums and example forms on this website. However,my problem is we filed out our taxes jointly this year since in the state of KS common law marriage is acceptable to file as married jointly. So, on the I-864 form(part 5 question 23 and 24 to be specific) should I enter only her income for the year since she is the one solely sponsoring me or enter our total income. I am also planning to send out copies of her W2 forms, last couple of paystubs and an employment letter. Any help on the issue will be greatly appreciated.

Only her income, unless you need your income to qualify, and you can prove that your income was legal and will come from the same source after you get the GC.

I don't think Kansas law translates to federal law, though. I don't think you should have filed federal taxes as married at all, but maybe I am wrong...
