Hello,

My name is Soraya. I'm from Thailand, and I came here with K-1 visa. I got married with my husband within 90 days after I arrived USA. I applied for Green Card right away after I got married. On 25th October, 2012 I got a letter from USCIS asking for bio-metrics which I did after that. A month and a half later I still haven't heard anything back from USCIS, so I called them on the phone asking what was wrong with my case because it has been awhile since I did my bio-metrics. A lady on the phone said " you're fine. just be patient because it takes awhile for the process" so I trusted her, believing that I will get a letter or something soon. And I have been checking my status online too, it saying that they were waiting for more evidence from a letter they mail me on 25th October, 2012, so the whole time I thought the letter they were talking about was the bio-metrics. A month later still nothing from USCIS, so I decided to call them again and a lady told me that on the 25th October they mailed 2 letters to me, one is for bio-metrics and one is for something else which she can't tell me what it was. So I started to panic because it has been so long, but she said i am fine i have time still and because I called in, so i am fine. She said she will resend the letter to me. 2 weeks later I finally got the letter saying that they want my translated birth certificate and my husband tax return. A few days later while we were preparing these papers, I got another letter from USCIS saying that my case I-485 was denied because I haven't respond to the papers request, and saying there is no appeal to the decision. I am shock! I have been waiting for 6 months and spent thousands for dollar for nothing? After that I called USCIS again I explain what happened and IT IS NOT MY FAULT! She only said "I am sorry there must be some mistakes" and she said I can file for motion something (sorry I cant remember the full name), but all I know is that I have to pay for a fee which is $700! for something that wasn't not my fault, and I really dont have money to pay for the fee on time. I really don't know what to do. Can anyone tell me if there is another way that they will re-open my case without me spending more money because I really dont have the money for the motion thing. Please help me I can't just re apply either because I will spend even more money on that. And if I dont do anything with it on time what will they do tome? Will they send me back to Thailand? But how can they separate husband and wife? It's not right! Please keep me on praying.

Make an INFOPASS appointment and talk to a human at your local office. You were denied because you did not respond to the RFE. However, you never got the letter, so tell them that and hopefully they can reopen the case for you.

Make an INFOPASS appointment and talk to a human at your local office. You were denied because you did not respond to the RFE. However, you never got the letter, so tell them that and hopefully they can reopen the case for you.

- 11/19/2012 EAD card delivered, one day ahead of my birthday!
- 1/11/2013 received txt and email about interview time
- 2/14/2013 interview - Got APPROVED on the spot!!
- 2/27/2013 USCIS online update - 485 decision!! we mailed you a notice that we had registered this customer's new permanent resident status :) Later, my 130 update too!!!
- 3/4/2013 Card Production!!

- 12/19/2014 early bio done in Long Island City Office!

Thank you so much :yes: But how can I make an INFOPASS appointment? I have to go to my local office and make an appointment from there? Or I can just call them?

You can do it online. Go to the USCIS website and type in the search box "infopass"

Make sure you take the second letter that they sent you along with the biometrics letter (that's if they are dated so they see the diff in dates)and make a copy for your records.

(Long gap in sending RFE back because I had to complete I-94 application and tried to wait for decision but ended up submitting RFE for I-864 with I-94 NOA)

12/30/2014 - EAD received

01/06/2014 - I-94 Approved!!!!!
02/06/2014 - Interview (had to go back to civil surgeon to re-do paperwork and make sure this time he signs it. Took care of it that very same day and dropped it off at the USCIS office the following morning.
02/14/2014 - Green card received!!!

Info pass is best idea. Simple to do on line. Take with you a simple statement asking explaining the basic problem for you not responding to the RFE which will serve as the " motion to reconsider " your case.
