Between the time the adjustment of status is application is filed and it is approved, the applicant is considered to be in legal status as an "applicant to adjust status." but not an immigrant.

Immigrant status is when visa processing is handled at the embassy or consulate as with IR-1/CR-1 and DCF visas.

To apply for a driver's license in the State of Florida, the DMV asks whether you are

1. US Citizen

2. Immigrant

3. Non-Immigrant

Which the is person who's applied and has not yet been given an approved AOS: 2 or 3?

Well that depends. Do Florida allow you to get a drivers license without a green card? Some states don't.

OK. Reading the Florida DMV website it seems to translate as follows:

If you have a Green Card then you're an "Immigrant"

If you have an EAD only (i.e. your AOS hasn't completed) then you're a "Non-immigrant".

Answer is 3 since you entered the country as a non-immigrant. Many states need a SS card, and EAD card to issue a driver's license.

Thanks dr and YuandDan!

I'll go with the non-immigrant.

The requirements aren't clear and I did call.

They said bring the approval; I said she's in the process of adjusting status; they said bring what you have.

The SSN is required and she's got that.

The EAD hasn't come back yet.

What we do have are three receipt notices for AOS, AP, and EAD.

She's going to do the learner's permit because w/o a DL, here you have to take a 4 hr course and pass the written exam. Then you have to have 50 hrs on the road with a licensed driver over I think it's 21 plus you cannot drive at night for the first three months before taking the actual driving test practical.

A K-1 who marries and files I-485 is a Non-Immigrant applying to adjust status to Legal Permanent Resident. lol

The K-1 has always been a bit of a hybrid - it is a non-immigrant visa used for the purposes of immigration. It is processed by the Immigrant Visa Section at the Consulates and you have to apply to adjust status to become an LPR once you are in the US. You are not considered an immigrant, because you never actually receive an immigrant visa, but a on-immigrant visa, even though your intention was to immigrate!

They just love to confuse people! lol
