hopefully im posting this at the right place, its been a while since i have been on the forums. Anyhow, here is my question:

I have a 2 year GC and its expiring in dec. which means i need to apply somewhere in late sept,. Now i need to go home sooner than that, which is affecting the re-applying process. Also, i need to stay a little bit longer at home due to some circumstances. Now, ..... what can i do to stay longer with my family? Do i cancel the trip and wait for the 10 year GC? And does that one allow me to stay outside US for a longer period of time?

Im sorry if im confusing with the way i present my question. Im just little bit confused since i dont know what rights and obligation i have with the GC.

I also need to travel with our child, which makes it even more complicated.

I would appreciate any advice you may have.

A GC is a GC is a GC. It does not matter if it is a 2 year GC or a 10 Year GC. Your responsibilities as a GC holder remain the same if you wish to keep your LPR status. The only issue you really have is your up coming trip and applying for ROC. You will need to be in the US to complete the biometrics for the ROC and answer any RFEs and attend an interview should you have one. Hopefully you will only have to go to the biometrics appointment and then receive the 10 year GC. CSC is processing June 2012 ROC applications so it will be a while before you actually receive the 10 year GC (VSC is not much better). You will use the NOA1 extension letter and your expired GC to re-enter the US after December You can apply anywhere from September to December, but I would not cut it too close to the expiration date of your GC. I would give them a month to process your application and send out the extension letter.
