Hello,

In reading through the informative posts here and some guides at USCIS.com I still am not sure what is the faster and/or "easier' way to apply for a the mother of a "new" US Citizen to get a green card.

Is it better to file while they are overseas, or have them enter the US then file the "one step" as listed at USCIS.com?

The mother does not speak English, but I am told by some prior filers there wouldn't be an interview if filed overseas, just a medical check. Does that seem correct?

any thoughts are appreciated.

The question is, if she were to file here, what visa would she enter under? If she enters under a tourist visa for the purpose of staying here and adjusting status, that would be fraud.

ok thanks. So is it better to get some sort of visa, or just file while the parent lives overseas?

Is the person barred from US entry with the VWP/ESTA during the process?

Mom will need an IR5 (Parent of a US citizen) immigrant visa. The US citizen son/daughter can file i-130. Mom waits for the IR5 visa in her home country. She will undergo a mandatory medical examination and will be subject to an interview at the US Embassy. It's not a problem if she can't speak English, the interview may be done in her native language.

Ok, thank you. I'd been reading up at USCIS.com but didn't cath the IR5 part. Great to know.
