Hello, I am a Naturalized US Citizen and just petitioned for parents and I also have a little brother who is currently 14 years of age and will be under 21 before his priority date.

My Questions are;

1. Will he be able to come with my parents or he will have to wait to be petitioned for later after my parents gets here?

2. If he will definitely have to wait till after my parents are here, how long is the wait time (Months or Years) and will he be in category 2A as i supposed?

3. What is the process for bring him here if he will have to wait and be petitioned for later?

Your brother will be a dependent on your parents; usually the whole process for petitioning parents of USC takes 10-12 months, so your brother will come with your parents if you included him in your parent petition

AOS

day 1 -- 04/11/2012-- package sent to Chicago

day 2 -- 04/12/2012-- package was received.

day 43-- 05/23/2012-- Notice for an interview is received for 06/26 @ 2pm

day 63-- 06/12/2012-- Received a Text & email for an update- Card production EAD/AP

day 77-- 06/26/2012-- interview / approved on the spot.

day 86-- 07/05/2012-- Received my GC in the mail.

ROC

day 1 -- 04/07/2014 -- ROC Package delivered to VSC

day 16 -- 04/23/2014 -- Walk-in Bio.

day 197 -- 10/20/2014-- Approval Letter received dated 10/16/2014

day 202 -- 10/25/2014-- GC received

Your brother will be a dependent on your parents; usually the whole process for petitioning parents of USC takes 10-12 months, so your brother will come with your parents if you included him in your parent petition

Your parents will get their in as yearish after filing , your brother is NOT included

You petition (sibling) is not age related same class for sibling from age 0 to 100+

Your parents can start their own petition when they get here for child of LPR under 21. This one is age dependant and CPSA comes into play.

This will not be over quickly. You will not enjoy this.

2. it will take 2-3 years as an F2.

3. one of your parents will file an I-130 for him, wait until his priority date becomes available(2-3 years) and then proceed with NVC (2 months ish) and embassy interview (1 month ish).

09/19/2011 - noa1 received

3/16/2012 - case sent to my local USCIS office for additional processing

4/21/2012 - AP. If we haven't heard from them in SIX MONTHS (omg) we can feel free to call them!!! Thanks!

9/20/2012 - Interview scheduled - October 3!!!!

10/3/2012 - Interview went well but she must look at his A-file more before decision.

10/12/2012 - I-130 APPROVED! APPROVED! APPROVED!

KIDS' CASES

04/20/2012: NOA107/20/2012: instead of an approval, we got thrown into AP. sigh

11/01/2012: Boys' I-130 interview set for November 28, 2012.

11/28/2012: I-130s APPROVED! APPROVED! APPROVED!

12/14/2012: NVC Received

12/31/2012: Case number/IIN

12/31/2012: DS-3032 sent

01/08/2013: DS-3032 accepted

01/02/2013: AOS bill0

1/03/2013: AOS bill shows PAID

01/04/2013: AOS package sent

01/09/2013: IV bill

01/10/2013: IV bill shows PAID

01/11/2013: IV package sent

01/23/2013: Case complete

02/01/2013: Interview scheduled

US Embassy Lagos

02/22/2013: Embassy received

03/01/2013: Medical

03/20/2013: Interview - was told the boys would have been approved on the spot if they had pics! Errrr :-(

04/15/2013: DNA test

05/15/2013: Emailed embassy BEGGING them to let boys drop off passports for visa insertion. IT WORKED!!!

05/31/2013: Visa in hand

06/02/2013: POE JFK!!!!!!

Thank you both of you. What I've read and learn is that he won't be able to come at the same time as my parent, but my parents can file for him as a dependent child after they gets here and the process could take anywhere from 12-24 months.

Your brother cannot immigrate with your parents as derivatives are not allowed in the IR categories.

Once your parents receive their green cards, one of them can file i-130 for your brother and he will be under the F2A category which will take 2-3 years to complete.

By the way, I would have mom petition for him, as if dad did, there might be a chance that he would have to do a DNA test (more time/more money). I know your parents are older, but hey, this is Nigeria we are talking about. You never know.
