Hi there, I arrived in the US on the 30th of December 2012 on a K 1, my 3 children accompanied me on their K 2's. Do I need to fill out and submit I-130's for my kids when I adjust status. It doesn't make much sense if I am already including them when I adjust my status, not to mention that the fee for the I 130 is $420....ugh over $1200 for all 3 kids.

I-130 is not used when adjusting status from K-1 or k-2.

This is not part of the K-1 process moving to the AOS forums.

I-130 it's only require if you got married here without using the regular visa like a k1 visa. In your case you only need to submit the i485 for you and your kids, the I864 with the supporting documents, and if you want , you can also apply fir work permit and travel permit with no additionals fee

you're probably thinking of Advance Parole which is the I-131, to file AOS it's the I-485; usually you'll file the I-131 with as well if you plan on working the I-765 together with the I-485.

I think the question is.... would you need to file the I-485 for all four of you?

USCIS

03/31/2012: I-129F sent to Dallas Lockbox

04/03/2012: I-129F recieved and sent to VSC

04/06/2012: NOA1 text/email.

04/09/2012: Touched.

04/12/2012: NOA1 hardcopy.

09/06/2012: Service request placed- They advised I should hear something by 9/21

09/17/2012: Received letter from USCIS just to be told i'm within' normal processing time bleh.

10/03/2012: NOA2 text received - Best part is it's our 2nd year anniversary!! Great Gift! :)

Sydney Consulate

10/21/2012: Packet 3 Received

11/30/2012: Sent packet 3

12/27/2012: Received packet 4 Interview date :)

01/22/2013: Medical completed

02/05/2013: Interview date status: APPROVED 306 Days!!

02/22/2013: Visa in Hand

02/24/2013: POE- Dallas, TX- then connecting flight home!

Total Time it took to complete our K1 process- 10 months and 3 weeks!!! INSANE! (325 days)
